As the Russian Federation continues to wage war and commit crimes against humanity in Ukraine, it is clear that, when this conflict is over, Ukraine will require huge amounts of assistance to rebuild its civilian infrastructure. The Russian Federation has accounts in several countries that are co-operating against Russia's war of aggression. All these countries should be called upon to take all necessary steps to provide for the transfer of title to these assets from the Russian Federation as needed to rebuild Ukraine’s infrastructure.

For this purpose, actions must be determined and coordinated between Council of Europe member States and with other States having custody of Russian Federation assets to include:

  • establishing an international fund to hold assets to pay for infrastructure projects in Ukraine;
  • transferring blocked assets to the international fund;
  • establishing a compensation tribunal to adjudicate, in accordance with established judicial norms, claims presented by Ukraine on behalf of its individuals, entities, and governmental entities, or directly by its individuals and entities as the tribunal rules provide.

The Russian Federation has the obligation under international law to compensate Ukraine, its citizens, companies and government, for damages caused by the Russian Federation’s unlawful acts accompanying its illegal invasion. Russia’s responsibility extends to re-establishing Ukraine’s agricultural system to relieve the massive famine and food insecurity in much of the world caused by Russia’s unlawful destruction of Ukraine’s crops, both in the field and in storage, and blocking distribution routes essential to feed so much of the world. These obligations establish in third countries the duty to safeguard the Russian Federation’s sovereign assets located within their jurisdictions for the benefit of Ukraine and to create an international compensation tribunal to ensure that damages caused by Russia are settled in accordance with international norms, and established jurisprudence and accounting principles.
