1. The Committee of Ministers points out
that Lithuania, like all the other member states of the Council
of Europe, has ratified the European Convention on Human Rights
and has undertaken to guarantee that all Convention rights are honoured,
including the right to freedom of expression under Article 10 of
the Convention, for everyone within its jurisdiction.
2. The Lithuanian authorities have informed the Committee of
Ministers that the case referred to by the Honorable Parliamentarian
is currently pending before the domestic courts, which are competent
to assess observance of constitutional rights in the light of European
standards, including the European Convention on Human Rights, which
is an integral part of the Lithuanian legal system. The Committee
of Ministers recalls that, in addition, if Mr A. Paleckis considers
it appropriate, he will also have the possibility of launching an
application before the European Court of Human Rights.
