The Assembly,

1. Considering the value, in view of the growing volume of trade, of equal protection of trademarks in European countries ;
2. Whereas the Madrid Arrangement concerning the international registration of trademarks merely ensures equal treatment between national and foreign trademarks ;
3. Noting that the Commission of the European Communities is preparing a regulation for the creation of a Community trademark for all of the member states and a directive on the approximation of the laws of trademarks in the member states ;
4. Inviting the Commission of the European Communities to consider the conditions under which participation in the system of EEC trademarks might be open to those member states of the Council of Europe which maintain close economic and commercial ties with the member states of the European Communities ;
5. Noting that in each of the member states of the European Communities the national law of trademarks will coexist with the future Community law of trademarks ;
6. In the belief that the harmonisation of the national trademark legislation of the member states of the Council of Europe is desirable.
7. Recommends that the Committee of Ministers :
7.1 work towards the harmonisation of the trademark legislation of the member states, taking into account the work of the European Communities, and prepare, if appropriate, a European convention ;
7.2 invite those of the member states which have not already done so to accede to the Madrid Arrangement of 14 April 1891 on the international registration of trademarks.
