The Assembly,

1. Noting that a contradiction exists between the Statute of the Council of Europe and the Rules of Procedure of the Assembly, in that the former states that the term of office of Representatives and Substitutes shall expire "at the opening of the next Ordinary Session or of a later Ordinary Session" (Article 25.a), whereas the latter does not include the last six words quoted above (Rule 7. paragraph 2) ;

2. Considering that this contradiction may give rise to difficulties when the credentials of members of the Assembly are being examined ;

3. Having regard to the report of its Committee on Rules of Procedure (Doc. 4704),

4. Resolves as follows :

a to amend paragraph 2 of Rule 7 of the Rules of Procedure (Duration of term of office of Representatives and Substitutes) to read as follows : "The term of office of Representatives and Substitutes shall expire at the opening of the next Ordinary Session or of a later Ordinary Session, subject to the provisions of paragraphs 3 and 4 below." ;

b to amend paragraph 1 of Rule 6 of the Rules of Procedure (Examination of credentials) accordingly, by adding the following sentence to the end of the paragraph : " When credentials are submitted, it shall be specified whether the Representatives and Substitutes have been appointed for a single session or for a longer period. " ;

c to add a footnote to paragraph 1 of Rule 6 of the Rules of Procedure, specifying the procedure to be followed in the case of members of the Assembly whose term of office has not expired.
