The Assembly,
Considering that the Greek Government has submitted to the Assembly a list of three candidates for the election of a judge of the European Court of Human Rights on behalf of Greece;
Considering that the main purpose of tire Convention on Human Rights is to guarantee, by safeguarding fundamental human rights, the proper functioning of democratic institutions including a duly elected Parliament;
Considering that the present Greek Government has suspended democratic activity in Greece and has not yet restored parliamentary Institutions, thus preventing a Greek parliamentary delegation from taking part in the work of this Assembly according to the requirements of the Statute of the Council of Europe including participation in the election of a Greek judge of the European Court of Human Rights,
Decides to postpone the election of a judge of the European Court of Human Rights on the list presented by Greece, until the first part-Session of the 20th Session of the Assembly and in the meantime instructs the Legal Committee to consider all the implications arising from the existing situation and in particular from the absence of a Greek delegation appointed by a freely elected Greek Parliament and to report to that part-Session before the election of the Greek judge is held.
