The Assembly,
Recalling its Recommendation 231 (1960) on the uniform interpretation of European treaties ;
Reaffirming its belief that the effectiveness of uniform legal provisions is to a great extent dependent on the uniformity of their interpretation and application ;
Convinced therefore that it is necessary that the member countries of the Council of Europe should agree on a procedure which would ensure a uniform interpretation of legal texts commonly agreed by them ;
Considering that various procedures, conciliatory, judicial and others, could be adopted to this end ;
Having regard to the report of the Legal Committee (Doc. 1650),
Recommends to the Committee of Ministers :
1 de soumettre ledit rapport pour étude au comité ad hoc de coopération juridique, institué par la Résolution (62) 41 du Comité des Ministres, en le chargeant d'étudier quelle procédure serait la mieux qualifiée pour assurer l'interprétation uniforme des traités européens, sans pour autant porter atteinte aux lois ou à la pratique constitutionnelle des Etats membres ;
2 de demander aux Ministres de la Justice des Etats membres d'étudier le problème de l'interprétation uniforme lors de leur prochaine Conférence.
