A Explanatory Memorandum

This report follows the instructions of the Order of the Assembly of 17th January, 1953. That Order instructed the Committee on General Affairs " to follow the work of the Ad Hoc Assembly in order to prepare a Draft Opinion thereon, to be discussed by the Consultative Assembly during the first part of the Fifth Ordinary Session, with a view to its subsequent transmission to the Committee of Ministers of the Council of Europe ".

The spirit of co-operation which animated the Constitutional Committee was fully maintained by the Ad Hoc Assembly, as is shown by the adoption of the Articles in t h e draft Treaty concerning Association, and by the inclusion of the Protocol on links with the Council of Europe.

The committee on General Affairs attaches the highest importance to the implementation of Article 6 and Article 7 (paragraph 1) of that Protocol.

Discussion in Committee : The draft Resolution was adopted in Committee by 13 votes to nil, with 3 abstentions.

B Draft Resolution

The Assembly,

Having considered the draft Treaty embodying the Statute of the European Community adopted by the Ad Hoc Assembly, 10th March, 1953, and communicated to the Consultative Assembly in accordance with the Resolution adopted at Luxembourg, 10th September 1952, by the six Ministers for Foreign Affairs of the Member States of the European Coal and Steel Community;

Welcoming most warmly the spirit of co-operation and the keen desire to maintain the unity of all Member States of the Council of Europe which have led the Ad Hoc Assembly t o adopt the proposals concerning Association and Liaison made in Resolution 26 of t h e Consultative Assembly adopted on 17th January, 1953,

Resolves concerning these two questions as follows :

I. Association
1. The Consultative Assembly accepts the provisions concerning Association contained in Articles 90, 91, 92 and 93 of the draft Statute of the European Community.
2. The Assembly, nevertheless, suggests that provision be made in the first paragraph of Article 91 for the participation in t h e Economie and Social Council of representatives of States which have concluded agreements of Association.
II. Links with the Council of Europe
3. The Consultative Assembly welcomes generally the provisions concerning the links to be established with the Council of Europe contained in the second Protocol appended to the draft Statute of the European Community.
4. The Consultative Assembly considers that the whole success of these proposals for establishing organic links between the European Community and the Council of Europe will depend largely, in practice, upon the realisation of the provisions of Article 6 and Article 7, paragraph 1, of the second Protocol. It therefore recommends that the provisions of these Articles be implemented immediately upon the setting up of the European Community, in accordance with the terms of Section D of Opinion No. 3, as adopted by the Consultative Assembly on 30th September, 1952.

C Draft Order of the Assembly relating to the transmission of the Resolution

The Assembly instructs the President to transmit Resolution to the President of the Ad Hoc Assembly, and to the Presidents of the Chambers of Parliament of the Member States of the European Coal and Steel Community.
