Amendments to Articles 41, 24, 29, 31 and 34 of the Statute consequential upon the first five Recommendations

Proposed Amendment to Article 41 [(1) Article 41:] [(1) (a) Proposals for the amendments of this Statute may be made in the Committee of Ministers or, in the conditions provided for in Article 23, in the Consultative Assembly.] [(1) (b) The Committee shall recommend and cause to be embodied in a Protocol those amendments wich it considers to be desirable.] [(1) (c) An amending Protocol shall come into force when it has been signed and ratified on behalf of two-thirds of the Members.] [(1) (d) Notwithstanding the provisions of the preceding paragraphs of this Article, amendments to Articles 23-35, 38 and 39 which have been approved by the Committee and by the Assembly, shall come into force on the date of the certificate of the Secretary-General, transmitted to the Governments of Members, certifying that they have been so approved. This paragraph shall not operate until the conclusion of the second ordinary session of the Assembly.]: Delete the last sentence of paragraph (d).

The Assembly recommends the drawing up of any further amendments as may be necessary to any other Articles of the Statute to bring them into line with the adoption of the Amendments listed above.

In particular, it recommends the following Amendments :

Article 24: Delete " under Article 23 " in line 3 ;

Article 29: Substitute for the words " subject to the provisions of Article 30 " in line 1, the wording " subject to the provisions of Articles 4, 5 and 30 " ;

Article 29: Substitute for subsection (ii) the following wording: " determining matters for discussion in the Assembly " :

Article 31: Substitute for " Debates on proposals to be made to the Committee of Ministers that a matter should be placed on the Agenda " by the following wording: " Debates on proposals for a matter to be placed on the Agenda " ;

Article 34: Insert after " The Committee of Ministers... " the words: " on its own initiative or at the request of the President of the Consultative Assembly... ".
