1. The Parliamentary Assembly refers to its Resolution 1417 (2005) on the protection of human rights in Kosovo.
2. The Assembly accordingly recommends that the Committee of Ministers :
make speedily the necessary arrangements for implementation of the mechanism of the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (ETS No. 126) by Kfor/Nato in Kosovo ;
commence work, in co-operation with Unmik and Kfor/Nato, towards establishing a human rights court for Kosovo, in accordance with the relevant paragraph of the above-mentioned resolution, and associate Serbia and Montenegro with this work ;
adopt, following consultation with the Assembly, a resolution inspired mutatis mutandis by Committee of Ministers’ Resolution (93) 6 on the control of respect for human rights in European states not yet members of the Council of Europe, containing rules on the nomination of judges for the human rights court for Kosovo and their appointment by the President of the European Court of Human Rights ;
adopt, following consultation with the Assembly, a resolution authorising the President of the European Court of Human Rights :
a to nominate independent international human rights experts to the Unmik advisory panel/human rights commission, once created ;
b to nominate independent international human rights experts to the Kfor Claims Appeal Commission/Advisory Board, once reformed ;
c to nominate international human rights experts, of high moral character and preferably though not necessarily with judicial experience, to be international judges in the special chamber of the supreme court on constitutional framework matters, once established ;
undertake a study on the possible interim extension of the jurisdiction of the European Court of Human Rights to all the inhabitants of Kosovo.
