We, the undersigned, declare the following:
In its Resolution
2482 (2023), the Parliamentary Assembly reiterated its
unanimous call on member States and observer States of the Council
of Europe to set up a special international criminal tribunal for
the crime of aggression against Ukraine, considered that the Heads
of State and Government of the Council of Europe, at their 4th Summit
in Reykjavik in May 2023, should give strong political support to
the creation of this tribunal, and invited them to provide Council
of Europe’s expert and technical support to the process of its establishment,
including inter alia by contributing to the drafting and negotiating
the necessary legal instruments, in close co-ordination with other
interested international organisations and States.
The Assembly also suggested that the role of the special international
criminal tribunal for the crime of aggression against Ukraine should
be complementary to the jurisdiction of the International Criminal
Court. This tribunal should have the features detailed in the above-mentioned
Assembly Resolution.
We call on all member and observer States to accede without
delay to the forthcoming enlarged partial agreement on the register
of damage caused by the Russian Federation’s aggression against
Ukraine.
