In the draft resolution, after paragraph 14, insert the following paragraph:

"As a general rule, permanent removal should only affect content that is lawfully deemed illegal in the framework of an appropriate national procedure, with judicial oversight available for all parties concerned, prior to any removal. Deviations from this principle should only be exceptional, in especially grave matters related to national security. Nonetheless, it is always essential to avoid creating procedures that allow for judicial control that is delayed or postponed, effectively denying justice."

Explanatory note

The amendment underlines that removal should always be exceptional and subject to prior judicial control (with exceptions in matters related to national security), in order to avoid vague guarantees of justice that is overly delayed and thus effecitvely denied.
