No human right to illegal immigration: does the Council of Europe agree?

Written question No. 813 to the Committee of Ministers | Doc. 16502 | 01 October 2026

Mr Pierre LAMELY, Germany, ECPA

On 22 September 2026, the President of the United States of America declared before the United Nations General Assembly: “There is no human right to illegal immigration, but there is a right to remain a sovereign nation, and we want to remain a sovereign nation, and so should you.” This statement referred to universal human rights within the United Nations framework and was explicitly addressed to other States. It raises the question whether the same principle applies within the European Convention on Human Rights.

Mr Lamely

To ask the Committee of Ministers:

Does the Committee of Ministers agree that this principle also applies within the Convention system?
