Activities of the Assembly’s Bureau and Standing Committee (29 January – 15 April 2021)

1 Introduction

At its meeting on 1st February 2021, the Bureau appointed me as rapporteur for this report, which covers its activities over the period from the last Bureau meeting of the first part-session of 2021 (Monday 1st February) to the first Bureau meeting of the second part-session of 2021 (Friday 16 April).

Chapter 2 presents a list of activities and decisions which do not require ratification. Chapter 3 presents decisions which have already been ratified by the Standing Committee on 19 March.

An addendum to this report will be issued after the Bureau meeting of 16 April, which will also include decisions to be ratified by the Assembly on 19 April.

The report of the Committee on the Election of Judges to the European Court of Human Rights presenting the conclusions of the committee on the lists of candidates submitted by Belgium and Poland are published as an Addendum 2 to this report.

The Bureau will hold its next meetings in Strasbourg by videoconference on Monday 26 April 2021 at 11 am, then on Thursday 27 May 2021 in Budapest (tbc). The next meeting of the Standing Committee will be held in Budapest on 28 May (tbc).

2 Activities of the Bureau since the last part-session and decisions not requiring ratification by the Assembly

2.1 Follow-up to the first part-session of 2021 (Strasbourg, 25-28 January)

On 1st February, the Bureau approved the follow-up proposals to the first part-session, made by the Secretary General of the Assembly, as follows:

Resolution 2358 (2021) on The implementation of judgments of the European Court of Human Rights, the Bureau decided to seize the Committee on Legal Affairs and Human Rights for the preparation of a report on this issue.
Current affairs debate on The arrest and detention of Alexei Navalny in January 2021, the Bureau decided to seize the Committee on Legal Affairs and Human Rights for the preparation of a report on this issue.
Current affairs debate on Freedom of expression (Article 10 of the ECHR) under threat by "Big Tech" Companies, the Bureau decided to refer this issue to the Committee on Culture, Science, Education and Media to be taken into account in the preparation of its report on The control of online communication: a threat to media pluralism, freedom of information and human dignity (reference 4496).
Presentation to the Bureau by the Secretary General of her Strategic Framework for the Council of Europe and trialogue discussions on 26 January 2021, the Bureau decided to seize the Committee on Political Affairs and Democracy to prepare a report – in time for a debate by the Assembly during the April 2021 part-session – on The Assembly’s vision on the strategic priorities for the Council of Europe.

2.2 Standing Committee meeting (videoconference, 19 March 2021)

On 1st February, the Bureau took note of the draft agenda. On 18 March, it took note of the revised draft agenda.

2.2.1 Requests for current affairs debates

On 18 March, the Bureau took note of the requests tabled by the five political groups to hold current affairs debates on:

“Democracies facing Covid-19: the way forward”, and decided to recommend to the Standing Committee to hold this debate and appointed Mr Ian Liddell-Grainger (United Kingdom, EC/DA) as the first speaker of this debate;
“Recent developments in Turkey concerning parliamentary democracy”, and decided to recommend to the Standing Committee to hold this debate and appointed Mr Frank Schwabe (Germany, SOC) as the first speaker of this debate.

2.3 Second part-session of 2021 (Strasbourg, 19-22 April)

On 1st February, the Bureau drew up the preliminary draft agenda. On 18 March, it decided to hold this part-session in a hybrid format and drew up the draft agenda

2.4 Communications

On 18 March, the Bureau took note of the communication by the President of the Assembly and of his intention to seize the Committee on Rules of Procedure, Immunities and Institutional Affairs following an exchange of views about a letter sent to him by Mr Liddell-Grainger. It also took note of the communication by the Secretary General and the Deputy Secretary General of the Council of Europe.

2.5 Organisation of committee meetings until 30 June 2021

On 1st February, the Bureau, taking into account the exceptional circumstances created by the Covid-19 pandemic, decided that committee meetings should be held in a hybrid manner (combined remote and in-person participation of members) or by electronic means of remote communication during the period from 1st February to 30 June 2021. In accordance with Rule 48.1, the committee chairperson shall decide on the format which he or she deems most appropriate when convening the meeting, taking into account safety and accessibility conditions.

2.6 Election observation

2.6.1 Bulgaria: parliamentary elections (4 April 2021)

On 1st February, the Bureau approved the list of members of the ad hoc committee to observe these elections. On 18 March, it approved the final list of members of the ad hoc committee (Appendix 1) and took note of the statement by the pre-electoral mission.

2.6.2 Albania: parliamentary elections (25 April 2021)

On 1st February, the Bureau approved the list of members of the ad hoc committee to observe these elections and appointed Mr. Aleksander Pociej (Poland, EPP/CD) as its Chairperson. On 18 March, it approved the final list of members of the ad hoc committee (Appendix 2).

2.6.3 Palestine: parliamentary elections (22 May 2021)

On 1st February, the Bureau took note of the provisional list of members of the ad hoc committee. On 18 March, it approved the updated list of members of the ad hoc committee to observe these elections and appointed Mr Claude Kern (France, ALDE) as its Chairperson (Appendix 3).

2.7 References and transmissions to committees

On 1st February, the Bureau decided to extend by six months the validity of all current references to committees.

On 18 March, considering the exceptional circumstances created by the pandemic of Covid-19 and in line with its prior decision to extend the validity of all current references to committees by one year in total, the Bureau decided to extend the terms of office of the rapporteurs of the Monitoring Committee by one year, including those which may have expired since 30 April 2020 in case there has been no replacement.

2.8 Issues raised by committees

2.8.1 Committee on Legal Affairs and Human Rights

On 1st February, the Bureau considered a letter by the Chairperson of the Committee expressing concerns about the lack of co-operation of the delegation of Azerbaijan with the Rapporteur for follow-up to Assembly Resolution 2322 (2020) on Reported cases of political prisoners in Azerbaijan (Ms Sunna Ævarsdóttir, Iceland, SOC) and took note that the President of the Assembly would be in contact with the Head of the Azerbaijani delegation on this issue.

2.8.2 Committee on Political Affairs and Democracy

On 18 March, the Bureau authorised Mr Kimmo Kiljunen (Finland, SOC) to carry out a fact-finding visit to Belarus, by the end of 2021, in the framework of the preparation of his report on Call for an inclusive national political process in Belarus.

2.9 Participation of members in Parliamentary Assembly plenary sessions and committee meetings

On 18 March, the Bureau took note of the information memorandum on the participation of members in Parliamentary Assembly plenary sessions and committee meetings in 2020 in accordance with Resolution 1583 (2007) and decided to publish the statistics relating to the participation of national delegations on the Assembly’s website.

2.10 2021 Václav Havel Human Rights Prize

On 1st February, the Bureau took note of the press release of the launch of the 2021 edition of the Prize.

On 18 March, the Bureau took note of the memorandum prepared by the Secretary General of the Assembly and re-appointed as members of the Selection Panel Ms Marie-Louise Bemelmans-Videc, for a third term of two years starting from 1st June 2021, as well as Ms Anne Brasseur and Mr Nils Muižnieks, for a second term of two years starting from 1st June 2021.

2.11 Institutional representation of the Parliamentary Assembly in 2021

On 1st February, the Bureau decided to invite the committees to review their proposals taking into account gender balance and postponed the approval of the nominations until its next meeting.

On 18 March, considered the nominations as set up in Appendix 4 and decided to approve them, with the exception of the proposals stemming from the Committee on Legal Affairs and Human Rights, which will reconsider them at its 22 March meeting.

2.12 Other business

On 18 March, the Bureau decided to confer the title of Honorary Secretary General of the Assembly to Mr Wojciech Sawicki, former Secretary General of the Assembly, with effect from the date that he ceased to be Secretary General of the Assembly.

3 Decisions taken by the Bureau at its meetings on 1st February and 18 March 2021, and subsequently ratified by the Standing Committee on 19 March

3.3 Composition of the Monitoring Committee, the Committee on Rules of Procedure, Immunities and Institutional Affairs, and the Committee on the Election of Judges to the European Court of Human Rights

3.3.1 Monitoring Committee

On 1st February, the Bureau:

on the basis of a proposal by the EPP/CD Group, appointed Ms Milena Damyanova (Bulgaria), Ms Elvira Kovács (Serbia) and Ms María Valentina Martínez Ferro (Spain) as members;
on the basis of a proposal by the EC/DA Group, appointed Mr Arkadiusz Mularczyk (Poland) as a member.

On 18 March, the Bureau:

on the basis of a proposal by the EC/DA group, appointed Mr Bob De Brabandere (Belgium) and Mr Asim Mollazada (Azerbaijan) as members;
on the basis of a proposal by the SOC group, appointed Ms Edite Estrela (Portugal) and Mr Gerardo Giovagnoli (San Marino) as members;

3.3.2 Committee on Rules of Procedure, Immunities and Institutional Affairs

on the basis of a proposal by the EPP/CD Group, appointed Ms Marie-Christine Dalloz (France) as a member.

3.3.3 Committee on the election of judges to the European Court of Human Rights

On 18 March, the Bureau, on the basis of a proposal by the EPP/CD group, appointed Mr Aleksander Pociej (Poland) as member.

4 Activities of the Standing Committee (videoconference, 19 March 2021)

The Standing Committee:

ratified the credentials of new members of the Assembly submitted by the delegations of Belgium, Hungary, Italy, Latvia and Romania;
approved changes in the composition of Assembly committees;
held an exchange of views with Mr Michael Roth, Minister of State for Europe at the Federal Foreign Office of Germany, Special Representative of the Federal Government for the German Presidency of the Committee of Ministers of the Council of Europe. During the exchange of views, issues were raised concerning, inter alia, the exchange of prisoners in the context of the conflict between Armenia and Azerbaijan; the situation of Mr Navalny; the threat of the banning of the People’s Democratic Party (HDP) in Turkey; the accession of the European Union to the European Convention on Human Rights; the rise of extremism in Europe; the participation of women in public life and online hate against women candidates; the prosecution by the German authorities of allegations of corruption in the Assembly;
heard of statement by Ms Marija Pejčinović Burić, Secretary General of the Council of Europe, on “Covid-19 and the role of the Council of Europe”;
held current affairs debates on “Democracies facing Covid-19: the way forward” and “Recent developments in Turkey concerning parliamentary democracy”;
took note of the draft agenda of the second part-session of the Parliamentary Assembly (19-22 April 2021);
