The Assembly,

Having been requested by the Committee of Ministers, in accordance with Article 41 (d) of the Statute, to consider an amendment to Article 26 of the Statute of the Council of Europe (Doc. 789) ;

Having considered Resolution (58) 3 of the Committee of Ministers;

Considering that Austria joined the Council of Europe on 16th April 1956 and the Saar ceased to be an Associate Member at the end of 1956,

Resolves that the proposed amendment be approved and that, accordingly, Article 26 of the Statute should read as follows:

Belgium - 7
Denmark - 5
France - 18
Federal Republic of Germany - 18
Greece - 7
Iceland - 3
Ireland - 4

B Explanatory Memorandum (Rapporteur ; M. STRASSER)

1. On 15th March 1958, the Standing Committee referred to the Political Committee a communication which had been received from the Committee of Ministers proposing an amendment to Article 26 of the Statute (Doc. 789).
2. It is recalled that under Article 41 of the Statute, amendments to Articles 23-35, 38 and 39 which have been approved by the Committee of Ministers and the Assembly come into force when the Secretary-General has issued a certificate stating that they have been so approved.
3. Article 26 of the Statute lays down the number of Representatives to which each Member State is entitled in the Consultative Assembly. At present it is as follows: Belgium 7 Denmark 5 France 18 Federal Republic of Germany 18 Greece 7 Iceland 3 Ireland 4 Italy 18 Luxembourg. 3 Netherlands. 7 Norway 5 Saar 3 Sweden. . 6 Turkey 10 United Kingdom of Great Britain and Northern Ireland 18
4. The effect of the proposed amendment is therefore to take account of the fact that Austria joined the Council of Europe in April 1956 and that the Saar ceased to be an Associate Member at the end of 1956.
5. Austria was allotted six seats in the Consultative Assembly by decision of the Committee of Ministers (Resolution (56) 4 of the Committee of Ministers dated 8th March 1956).
