1 1. Letter from the Chairman of the Committee of Ministers to the President of the Assembly

Paris, 15th December 1958

Dear Mr. President,

I have the honour to send you herewith the list of candidates for the European Court of Human Rights, as established by the Committee of Ministers at its 23rd Session.

The list, which has been drawn up by the Governments of the Member States of the Council of Europe in accordance with Article 39 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, gives the name and nationality of the candidates and the Governments presenting them. It is accompanied by a biographical note on each candidate.

Although the Convention makes no express stipulation to that effect, the Committee of Ministers has itself decided to combine into a single list, as specified in the aforesaid Article 39, the fifteen lists submitted by the Governments of Member States.

The Committee of Ministers has unanimously recognised that the judges will sit in a purely individual capacity and will enjoy, in the exercise of their high office, the complete independence implied by the Convention. It considers that in this respect the candidates presented offer the fullest possible guarantees, together with all the qualifications required by Article 39, paragraph 3.

Desirous of complying with the wish expressed by the Consultative Assembly in its Recommendation 183 of the 17th October 1958 (paragraph 1), the Governments of Member States and t he Committee of Ministers are anxious that you should receive this communication at the earliest possible date, so t h a t the Assembly may proceed to elect the members of the Court at its next part-Session.
