Amendment of certain provisions in the Rules of Procedure

The Assembly,

1. Having regard to the report of the Committee on Rules of Procedure ;

2. Considering that Rule 37, paragraph 2, of the Rules of Procedure, reading as follows :

"The Assembly shall not take any decision other than those provided for in paragraph 1 above unless more than half the Representatives to the Assembly provided for in the Statute are present",

is open to conflicting interpretations,

3. Resolves to replace the words "provided for in the Statute" in that paragraph by "provided for in Article 25 of the Statute" ;

4. Considering Rule 28, paragraph 3, of the Rules of Procedure, reading as follows :

"When examination of the texts has been concluded, only explanations of vote may be made before the vote is taken on the text as a whole",

5. Resolves, as an interim measure, that such explanations of vote may relate only to the entire text of a draft opinion, recommendation, resolution or order ; and instructs the Committee on Rules of Procedure to give further consideration to the more general question whether the procedure of oral explanation of vote after the conclusion of a debate is really essential or desirable and to consider alternatives to the existing procedure so far as necessary ;

6. Having regard to its Resolution 339 (1967) on the tabling of amendments in the course of a debate, and to the report of its Committee on Rules of Procedure,Doc. 2138, on the same matter,

7. Considers that to modify an amendment during a plenary sitting is tantamount to tabling a fresh amendment, and that motions to modify an amendment during a plenary sitting may be allowed under the conditions laid down in Rule 30, paragraph 2, of the Rules of Procedure.
