The Assembly,

1. Having considered the report of the Legal Committee,
2. Affirms the right of the Assembly which has full responsibility for its own agenda to proceed in the light of all relevant circumstances with the election of judges of the European Court of Human Rights, in conformity with the requirements of Article 39 of the European Convention on Human Rights ;
3. Regrets that the election of a judge in respect of Greece should be held in the absence of a delegation elected by the Greek Parliament or appointed in such manner as that Parliament decided (Article 25 of the Statute) ;
4. States that this election of a judge of the European Court in such circumstances and, in particular, in the absence of a parliamentary delegation from the country concerned shall in no way prejudge the procedure to be followed for future elections.
