In the draft resolution, after paragraph 6, insert the following paragraph:

"The Assembly strongly condemns the ongoing violation by the Russian Federation of the Court's interim measures in relation to military actions in Georgia (see Georgia vs. Russia II)."

Explanatory note

On August 12, 2008 ECHR decided to apply Rule 39 and called upon both Parties of the 2008 war between Russia and Georgia to comply with their engagements under the Convention. The application of Rule 39 has since been prolonged several times. The interim measures continue to be not implemented by the Russian Federation.
