The Assembly,

1. Noting that sub-paragraph (b) and the first part of sub-paragraph (c) of Rule 45 (4) may give rise to ambiguity as regards the election of committee Chairmen and Vice-Chairmen in the case of a tie and as far as the quorum is concerned

2. Having seen the report of its Committee on Rules of Procedure (Doc. 3224),

3. Decides ;

a to add to sub-paragraph (b) of Rule 45 (4) the following :

3.1.1 "In case of a tie, there shall be a third ballot ; in the case of a renewed tie, the candidate senior in age shall be declared elected." ;

3.1.2 to replace the first part of sub-paragraph (c) of Rule 45 (4) by the following :

3.1.2.1 "A committee may deliberate and take decisions when one third of its members are present ; however, the vote on a report as a whole and the election of the Chairman and Vice-Chairmen, if such election is held by ballot, may not take place unless the majority of the members of the committee are present."
