1 Introduction

At its meeting on 13 October 2023, the Bureau appointed me as rapporteur for this report, which covers its activities over the period from the last Bureau meeting of the fourth part-session of 2023 (Friday 13 October) to the pre-session Bureau meeting of the first part-session of 2024 (Monday 22 January 2024).

The present report includes the decisions taken at the Bureau meetings held on 13 October 2023 in Strasbourg, on 27 November 2023 in Vaduz, and on 14 December 2023 in Paris. Chapter 2 presents a list of decisions that were either already ratified by the Standing Committee on 28 November 2023, or which do not require ratification. Chapter 3 presents the activities of the Standing Committee on 28 November 2023 in Vaduz. Chapter 4 lists the decisions taken on 14 December 2023 that require ratification at the opening of the 2024 first part-session of the Assembly.

An addendum to this report will be issued after the Bureau meeting of 22 January 2024, which will also include decisions to be ratified by the Assembly at the opening of the 2024 first part-session. Another addendum will be issued after the Bureau meeting of 26 January. It will only include the decisions to be ratified by the Assembly on the same day, notably the references and transmissions to committees which will have been approved by the Bureau.

Addendum 1 to this report presents the statistics of gender equality in the functioning of the Assembly.

The report of the election of the Council of Europe Commissioner for Human Rights is published as Addendum 2rev.

The report of the Committee on the Election of Judges to the European Court of Human Rights presenting the conclusions of the committee on the lists of candidates submitted by Bulgaria, Lithuania, Luxembourg and Serbia is published as Addendum 3 to this report.

Addendum 4 to this report presents the activities of the elections observations in 2023.

The Bureau will hold its next meeting on Thursday 7 March 2023 in Paris.

2 Activities of the Bureau since the last part-session and decisions not requiring ratification by the Assembly

2.1 Follow-up to the fourth part-session of 2023 (Strasbourg, 9-13 October)

On 13 October, the Bureau approved the follow-up proposals to the fourth part-session, made by the Secretary General of the Assembly, as follows:

  • Current affairs debate on “The situation in the North of Kosovo*Note following the recent attack and the need for de-escalation”, decided to refer the matter to the Committee on Political Affairs and democracy for information;
  • Current affairs debate on “Escalation of violence in the Middle-East following the recent Hamas attack on Israel”, decided to seize the Committee on Political Affairs and Democracy on this issue to be taken into account in the preparation of its report on “Recent developments in Libya and in the Middle East: what consequences for Europe?”.

On the same day, the Bureau took note of the President’s proposal, supported by the Presidential Committee, to establish a regular contact platform for dialogue with representatives of Russian democratic forces who share Council of Europe values, fully respect Ukraine’s territorial integrity and condemn the Russian Federation’s war of aggression against Ukraine.

It also took note that the President would address a letter to the Venice Commission requesting for its opinion on the legislative framework and practice on targeted surveillance of all member States, as decided by the Assembly in its Resolution 2513 (2023) “Pegasus and similar spyware and secret state surveillance”.

2.2 Standing Committee (Vaduz, 28 November 2023)

2.2.1 Requests for current affairs debates

On 27 November, the Bureau took note of the requests to hold current affairs debates on:

  • “Spain and rule of law: current situation”, addressed by the EC/DA group, and decided to recommend to the Standing Committee not to hold this debate;
  • “Spiral of violence and humanitarian crisis in the Middle-East: finding a peaceful way out”, addressed by leaders of political groups, decided to recommend to the Standing Committee to hold this debate and appointed Mr Aleksander Pociej (Poland, EPP/CD) as the first speaker;
  • “Budget and priorities of the Council of Europe and follow up to the Reykjavik Summit”, addressed by leaders of political groups, decided to recommend to the Standing Committee to hold this debate and appointed Ms Ingjerd Schie Schou (Norway, EPP/CD) as the first speaker.

2.2.2 Draft agenda

On 13 October, the Bureau took note of the draft agenda and updated it on 27 November.

2.2.3 Follow-up

On 14 December, the Bureau took note of the information provided by the Secretary General of the Assembly.

Following an exchange of views at the Bureau and at the Standing Committee of the Parliamentary Assembly of the Council of Europe in Vaduz on 27-28 November 2023, with respect to a request for a current affairs debate on “Spain and the rule of law: current situation”, the President decided to ask the Venice Commission to prepare a study on the rule of law requirements that an amnesty should fulfil.

2.3 First part-session of 2024 (Strasbourg, 22-26 January)

On 27 November, the Bureau agreed to hold the forthcoming part-session along the modalities and according to the schedule presented by the Secretary General of the Parliamentary Assembly, as laid down in the preliminary draft agenda. It also decided that the Assembly shall proceed to the election of judges to the European Court of Human Rights, and other high-level personalities of the Council of Europe, in accordance with the standard secret voting procedure laid down in the Rules of Procedure (Rule 40.11), using ballot papers and boxes. On the same day, it drew up the preliminary draft agenda.

On 14 December, the Bureau took note of the request to hold a debate under the urgent procedure on “The situation of the children of Ukraine”, presented by the leaders of political groups, and drew up the draft agenda.

2.4 Follow-up to the Reykjavik Summit

During its meetings on 13 October, 27 November and 14 December, the Bureau took note of the information provided by the Director of Committees – Human Dignity and Sustainable Development. It also heard her presentations on 27 November and 14 December as regard the website dedicated to PACE follow-up to the Reykjavik Summit.

2.5 Application for membership set out in the letter of 12 May 2022 addressed to the Secretary General of the Council of Europe, in line with Statutory Resolution (51) 30

On 27 November, the Bureau took note of the report by the two eminent lawyers appointed by the Bureau, who, according to established practice, drew up a report for the attention of the Bureau assessing the conformity of the applicant's legal system with Council of Europe standards, and decided to declassify it.

2.6 Communications

On 13 October, the Bureau took note of the statement by the President of the Assembly. On 27 November and on 14 December, the Bureau took note of the communications by the President of the Assembly, the Secretary General and the Deputy Secretary General of the Council of Europe. An exchange of views was held with the Secretary General on 27 November, and with the Deputy Secretary General on 14 December.

2.7 Election of the Council of Europe Commissioner for Human Rights

On 14 December, the Bureau took note of the report drawn up by the Committee on Legal Affairs and Human Rights and decided to declassify it.

2.8 Election observation

2.8.1 Poland: parliamentary elections (15 October 2023)

On 27 November, the Bureau approved the report by the observation mission.

2.8.2 Serbia: early parliamentary election (17 December 2023)

On 13 October, the Bureau, subject to receiving an invitation and the confirmation of the date, decided to observe these elections and to set up an ad hoc committee composed of 20 members (SOC-6; EPP/CD-6; ALDE-4; EC/DA-3; UEL-1), as well as the two co-rapporteurs of the Monitoring Committee, and to conduct a pre-electoral mission (ratified by the Assembly the same day – Doc. 15834 Add. 3). On 27 November, the Bureau took note of the statement by the pre-electoral observation mission and approved the final list of members of the ad hoc committee (appendix 1).

2.8.3 Schedule of the elections

On 14 December, the Bureau took note of the calendar for 2024.

2.9 References and transmissions to committees

On 13 October, the Bureau considered and approved the reference and transmissions to committees as presented in Doc. 15834 Add. 3, ratified by the Assembly the same day.

On 27 November, the Bureau considered and approved the following references and transmissions which were subsequently ratified by the Assembly:

2.9.1 References and transmissions to committees

  • Responding to the violent attacks in the North of Kosovo*, Doc. 15845: transmission to the Committee on Political Affairs and Democracy for consultation
  • Tools to prevent and address transnational repression, Doc. 15847: transmission to Committee on Legal Affairs and Human Rights for information [to be taken into account in the follow-up to the report on “Transnational repression as a growing threat to the rule of law and human rights”]
  • Strengthening democracy through participatory and deliberative processes, Doc. 15848: reference to the Committee on Political Affairs and Democracy for report

  • The Council of Europe Development Bank: implementing the Reykjavík Declaration, Bureau decision: reference to the Committee on Social Affairs, Health and Sustainable Development for report.

2.9.3 Requests for extension of references

On 14 December, the Bureau considered and approved the following requests:

  • Legal aspects of the accession of the European Union to the European Convention on Human Rights, Doc. 15014, Reference 4488 of 27 January 2020 – validity: 27 January 2024: extension until 30 June 2024.
  • The honouring of membership obligations to the Council of Europe by the Netherlands, Reference 4569 of 19 March 2021 – validity: 19 March 2024: extension until 19 March 2025.
  • Respect for the rule of law and fight against corruption within the Council of Europe, Doc. 15195, Reference 4556 of 25 January 2021 – validity: 31 December 2023: extension until 31 December 2024.

2.10 Composition of the Committee on the Election of Judges to the European Court of Human Rights

On 27 November, the Bureau, on the basis of proposals by:

  • the SOC group, nominated Ms Gala Veldhoen (Netherlands) as a member;
  • the UEL group, nominated Mr Frédéric Mathieu (France) as a member.

2.11 Issues raised by committees

2.11.1 Committee on Social Affairs, Health and Sustainable Development

On 13 October, the Bureau took note of the letter by the committee, decided to set up an ad hoc committee of the Bureau to participate in a PACE co-operation event on “The situation of the children of Ukraine”, on 15 December 2023, in Paris (ratified by the Assembly the same day – Doc. 15834 Add. 3).

2.11.2 Committee on Political Affairs and Democracy

On 13 October, the Bureau considered and approved the terms of reference of the General Rapporteur on Democracy, and took note that the mandate would start in January 2024 (ratified by the Assembly the same day – Doc. 15834 Add. 3).

2.11.3 Committee on Legal Affairs and Human Rights

On 27 November, the Bureau authorised Ms Azadeh Rojhan (Sweden, SOC) to carry-out a fact-finding visit to Kosovo* in early December 2023 (dates to be confirmed), in her capacity as Rapporteur for opinion on the Statutory Opinion on the application for membership set out in the letter of 12 May 2022 addressed to the Secretary General of the Council of Europe, in line with Statutory Resolution (51) 30.

2.11.4 Committee on Equality and Non-Discrimination

On 27 November, the Bureau authorised Ms Béatrice Fresko-Rolfo (Monaco, ALDE) to carry-out a fact-finding visit to Kosovo* in early December 2023 (dates to be confirmed), in her capacity as Rapporteur for opinion on the Statutory Opinion on the application for membership set out in the letter of 12 May 2022 addressed to the Secretary General of the Council of Europe, in line with Statutory Resolution (51) 30.

2.12 The situation of the children of Ukraine (Paris, 15 December 2023)

On 27 November, the Bureau approved the list of members of the ad hoc committee and appointed Ms Olena Khomenko (Ukraine, EC/DA) as chairperson. On 14 December, it approved the final list of members of the ad hoc committee to take part in the event (Appendix 2)

2.13 Expenditure of the Parliamentary Assembly for the 2024 financial year

On 14 December, the Bureau took note of the memorandum prepared by the Secretary General of the Assembly.

2.14 Apportionment of the allocation to political groups for 2024

On 14 December, the Bureau approved the proposals contained in the document.

2.15 Parliamentary co-operation activities

On 14 December, the Bureau took note of the work plan for 2024.

2.16 Meetings elsewhere than Strasbourg and Paris

On 27 November, the Bureau authorised the ad hoc sub-committee to participate in the Helsinki Dialogue of the Committee on Political Affairs and Democracy, to meet in Helsinki on 11-12 January 2024.

On 14 December, the Bureau authorised:

  • the Committee on Culture, Science, Education and Media to meet in Copenhagen, on 27-28 May 2024;
  • the ad hoc Sub-Committee to participate in the Commission on the Status of Women (CSW 68) of the Committee on Equality and Non-Discrimination to meet in New-York, in March 2024;
  • the Committee on Equality and Non-Discrimination and the Parliamentary Network Women Free from Violence to meet in Tirana, in June 2024.

2.17 2023 World Forum for Democracy (Strasbourg, 6-8 November)

On 13 October, the Bureau approved the final list of members of the ad hoc committee (Appendix 3).

2.18 Conference on “Money and Democracy – an Uneasy Relationship” (Cologne, Germany, 7-8 December 2023)

On 13 October, the Bureau approved the composition of the ad hoc committee and designated Mr Georges Papandreou (Greece, SOC) as chairperson (Appendix 4).

2.19 European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) – Lists of candidates in respect of Armenia, Greece, Ireland, Italy, Latvia, Portugal, Romania

On 13 October, the Bureau approved the lists of candidates in respect of these countries to be forwarded to the Committee of Ministers.

2.20 2024 Václav Havel Human Rights Prize

On 14 December, the Bureau took note of the calendar of the 2024 edition of the Prize.

2.21 2024 Vigdís Prize for Women’s Empowerment

On 13 October, the Bureau took note of the letter by the Committee on Equality and Non-Discrimination and approved the designations of Mr Robert Biedron, Ms Sandra Konstatsky and Ms Iris Luarasi as the independent members of the Selection Panel. On 14 December, it took note of the calendar of the 2024 edition of the Prize.

3 Activities of the Standing Committee (Vaduz, 28 November 2023)

The Standing Committee:

  • heard an opening speech by Mr Albert Frick, President of the Landtag;
  • held an exchange of views with Ms Dominique Hasler, Minister of Foreign Affairs, Education and Sport of Liechtenstein, President of the Council of Europe Committee of Ministers;
  • ratified the credentials of new members of the Assembly submitted by the delegations of France and Norway;
  • approved the changes in the composition of Assembly committees;
  • took note of the preliminary draft agenda of the first part-session of the Assembly (22-26 January 2024);
  • ratified the references proposed by the Bureau;
  • held a current affairs debate on “Budget and priorities of the Council of Europe and follow-up to the Reykjavík Summit”;
  • within the framework of the Event on the Vigdís Prize for Women’s Empowerment, held an interactive panel discussion moderated by Ms Mariia Mezentseva, Chairperson of the Committee on Equality and Non-Discrimination of the Parliamentary Assembly, with the participation of Mr Tiny Kox, President of the Parliamentary Assembly of the Council of Europe; Ms Bernadette Kubik-Risch, Equal opportunities expert, Liechtenstein; Mr Wilfried Marxer, President of the Association for Human Rights, Liechtenstein; and Ms Rósa Björk Brynjólfsdóttir, member of the Selection Panel of the Vigdís Prize for Women’s Empowerment, Office of the Prime Minister of Iceland, followed by an exchange of views;
  • held a current affairs debate on ”Spiral of violence and humanitarian crisis in the Middle East: finding a peaceful way out”;
  • took note of the report of the Ad hoc Committee of the Bureau on the Observation of the parliamentary elections in Poland (15 October 2023);
