Crime of aggression is a leadership crime and there can be no space left for personal immunities.

In the draft resolution, at the end of paragraph 17, insert the following sentence:
"In this regard, the Assembly urges the Russian Federation to comply with the recent judgment of the European Court of Human Rights in the inter-State case of Ukraine v. Russia (re Crimea), concerning multiple violations of the Convention beginning in February 2014, and in particular with the obligation to ensure, as soon as possible, the safe return of the relevant prisoners transferred from Crimea to penal facilities located on the territory of the Russian Federation."
Explanatory note
The amendment aims to include a reference to the judgment delivered on 25 June 2024 by the Grand Chamber of the European Court of Human Rights concerning events in Crimea since 2014, including the explicit order by the Court in the operative part of the judgment concerning the return of transferred prisoners from Crimea.
