The term of office of Mr Andreas Zünd, judge in respect of Switzerland at the European Court of Human Rights, will expire on 8 February 2027. With a view to filling this post, the Swiss authorities have the honour of submitting the nominations of the following three individuals, whose curriculum vitae are attached:

2 Information on the national selection procedure for candidates for election as judge to the European Court of Human Rights in respect of Switzerland

Summary of the national nomination procedure for the three candidates (M/F) on the Swiss Government’s list

The post of Swiss judge at the European Court of Human Rights was advertised in September 2025 in the online and print editions of a leading daily newspaper in each of the three linguistic regions (Neue Zürcher Zeitung, Le Temps, Il Corriere del Ticino), as well as on the Confederation’s job portal (https://www.stelle.admin.ch/stelle/fr/home.html). At the same time, the vacancy notice was brought to the attention of the presidents of the federal courts and the higher cantonal courts by email. The deadline for submitting applications was 31 October 2025.

Twenty-one people applied. The government shortlisted seven candidates. In addition to qualifications, it took into account criteria relating to gender (four women, three men), linguistic region (three people from French-speaking Switzerland, three from German-speaking Switzerland and one from Italian-speaking Switzerland) and the type of legal profession represented (representatives from the judicial and academic sectors).

The government then forwarded the files of the seven shortlisted candidates (along with the names of five other candidates) to the Swiss Parliamentary Delegation to the Council of Europe (DCE). The DCE involved the Judicial Committee (CJ) of the Federal Assembly – which is responsible for preparing the election of federal judges – in the selection process. On 25 February 2026, these seven candidates attended a hearing before a joint meeting of the DCE and the CJ. The two bodies drew up a recommendation comprising three names listed in alphabetical order. The Chair of the DCE forwarded this recommendation to the Federal Council in a letter dated 26 February 2026, together with an assessment of the hearings.

On this basis, the Federal Council adopted the following list of candidates on 1 April 2026:

  • Ms Jeanine de Vries Reilingh, Doctor of Law, judge at the Neuchâtel Cantonal Court of Justice;
  • Ms Julia Hänni, professor of law, judge at the Federal Supreme Court;
  • Mr Giuseppe Muschietti, lic. iur., LLM, judge at the Federal Supreme Court.

IV. Activities and experience in the field of human rights

During my studies, I developed a keen interest in international instruments for the protection of human rights. I devoted research to this area, culminating in the publication of a doctoral thesis (PhD – see II.) on two treaties that show strong parallels with the ECHR, namely UN Covenants I and II. I undertook their analysis and evaluated their judicial application in three federal States: Switzerland, Germany and Canada.

This interest in human rights has endured and I have since then published different contributions related to fundamental guarantees, particularly those of the ECHR (see VII.).

For over 15 years I have served as a judge at the highest cantonal court. This is a supreme court within our federal system, which also exercises constitutional and conventional review. Some of its judgments are final and not subject to ordinary appeal. Drawing on a solid academic background and grounded in the realities underlying the disputes brought before us, I strive to apply Convention rights in a credible manner on a daily basis. Indeed, in the four weeks before the hearings in front of the commissions of our Federal Parliament, I took care to list the Convention rights invoked before our court. During this short period, our review addressed on several occasions the right to respect for family life (art. 8), measures of constraint (art. 5), the right to a fair trial with procedural guarantees (art. 6) and inhuman and degrading treatment (forced medication, art. 3). The application of the ECHR is an integral part of my daily work.

The implementation of human rights involves not only judicial activity: it is also necessary to ensure, beforehand, that the judicial authorities function properly. In this regard, my commitment to key positions in the management of these authorities (in the Administrative Commission of the Judicial Authorities, see V.a.) and the oversight of their proper functioning (within the Judicial Council, see V.a.), which involves inter-cantonal and federal projects, has given me expertise that is useful in structurally ensuring an effective application of the rights of the Convention.

IV. Activities and experience in the field of human rights

My activities and experience in the field of human rights encompass judicial service at the Swiss Federal Supreme Court, as well as research and teaching.

Serving as a national judge at the Swiss Federal Supreme Court since 2019 has given me practical experience in applying the Convention at the national level. I serve in the II. Public Law Division of the Swiss Federal Supreme Court, which is, to a large extent, dedicated to constitutional and Convention law matters. This includes cases concerning freedom of religion and conscience, freedom of expression and information, equality before the law, the prohibition of discrimination, and economic freedoms. I deal with most of the key questions of Swiss constitutional law, as interpreted in the light of the European Convention on Human Rights (ECHR).

I have published numerous articles in the field of human rights, addressing both constitutional law and the ECHR. I regularly participate in meetings of the highest German-speaking European constitutional courts, and gave a short talk on Religious Freedom at the at the German Federal Constitutional Courtin in Karlsruhe, as well as on the Case Law on Equality before the Law at the Court of Justice of the European Union (CJEU) in Luxemburg. I have conducted comparative research on how supreme courts in different jurisdictions approach Convention questions. I was given the opportunity to share my experience and present my research on exhaustion of domestic remedies and subsidiarity at the opening of the 2024 Judicial Year at the European Court of Human Rights (ECtHR).

Alongside judicial work, I teach law and legal philosophy with a focus on the development of constitutional and human rights law. My courses emphasise critical analysis of fundamental rights in current ethical debates, the theoretical foundations of law, and the interplay between national constitutions and international courts. Students engage in discussions on both doctrinal principles and practical applications, fostering a nuanced understanding of contemporary constitutional and human rights challenges.
