Summary

The Parliamentary Assembly of the Council of Europe reaffirms its commitment to combat impunity in serious human rights violations and corruption, particularly regarding the fraud unveiled by Sergei Magnitsky. Magnitsky, who exposed a significant financial crime involving Russian officials, subsequently suffered inhumane treatment which led to his death, with no accountability for the perpetrators. Despite various international actions and investigations into the laundering of these fraud proceeds, some outcomes have been unsatisfactory, notably in Switzerland, where serious allegations of misconduct have arisen, and assets of known associates to the Russian state apparatus have not been fully confiscated. The Assembly urges Switzerland and other member states to enhance their legal frameworks regarding non-conviction-based confiscations and to push forward with actions to refreeze and recover assets linked to Magnitsky’s case. Furthermore, it calls upon the Swiss authorities to align their practices with modern asset recovery standards, and urges more states to adopt targeted sanctions against individuals benefiting from such fraud and human rights abuses. The Assembly also suggests the European Union expand sanctions related to corruption and urges international bodies to promote reversing the burden of proof on unexplained wealth.
