Transnational repression as a growing threat to the rule of law and human rights

1. Referring to its Resolution 2509 (2023) “Transnational repression as a growing threat to the rule of law and human rights”, the Parliamentary Assembly recommends that the Committee of Ministers:

1.1 review and update the “Eradicating impunity for serious human rights violations” guidelines, adopted on 30 March 2011 at the 1110th meeting of the Ministers’ Deputies, with a view to including transnational repression techniques;

1.2 consider drawing up a recommendation to member States on the fight against transnational repression, taking due account of international human rights law and in particular the case law of the European Court of Human Rights. Such a recommendation would include a definition of transnational repression that could be later adopted by member States and Council of Europe bodies;

1.3 when supervising the execution of the European Court of Human Rights’ judgments concerning cases which feature transnational repression, underline the requirement of individual accountability of perpetrators and call on the States concerned to adopt general measures to prevent these practices in future and provide guarantees of non-repetition.
