[…] I have the honour to refer to your letter of 20 July 2024 addressed to my predecessor, Mr Joan Forner Rovira, […]. In this regard, on behalf of the Government of Andorra, I am pleased to send you, in accordance with Article 22 of the Convention, the list (in alphabetical order) and the Curriculum Vitae of the following three candidates for the post of Judge in respect of Andorra:

2 Information on the national selection procedure applied in Andorra to designate three candidates for the post of Judge of the European Court of Human Rights

2.1 Publication of the call for applications

[...] The Government of the Principality of Andorra, at the meeting of the Council of Ministers on 6 December 2023, approved the call for applications which opens the procedure for the selection of the three candidates who will be part of the national list.

On 13 December 2023, the call was published in the Official Journal. All interested persons who fulfilled the conditions established by the recommendations of the Parliamentary Assembly of the Council of Europe (PACE) and the European Convention on Human Rights had to submit their candidacy together with their Curriculum Vitae in French and English to the Ministry of Foreign Affairs by 19 January 2024. Only one application was received.

On 24 January 2024, a second announcement was published in the Official Journal setting the deadline for applications at 15 March 2024. Two applications were received.

On 21 February 2024, a third announcement was published in the Official Journal with the deadline of 15 March 2024. Two applications were received.

On 21 March 2024, a final call was published, with the deadline for applications expiring on 12 April 2024, and three applications were received.

However, on 20 July 2024 PACE communicated that the submitted list of candidates had been rejected because not all candidates fulfilled the required conditions.

As a result, the Government of Andorra decided to relaunch the procedure by publishing on 25 September 2024 a new call for applications until 11 October 2024, and three applications were received.

2.2 Establishment of a Selection Committee

The Selection Committee was composed of the following members:

1 Mr Joan Manel Abril Campoy, President of the Constitutional Court. Chairman of the Evaluation Committee.
2 Ms Florence Benoît-Rohmer, French lawyer, expert in human rights, and professor at the University of Strasbourg.
3 Mr Pere Vilanova, expert in constitutional law and member of the Venice Commission.
4 Ms Eva Garcia Lluelles, Head of Relations and International Legal Cooperation of the Ministry of Justice and the Interior, Government Agent at the European Court of Human Rights and therefore familiar with the work of the Court.
5 Ms Mireia Fernandez, member of the Legal Cabinet of the Government.
6 Mr Jeroni X. Estopinàn Pascual, Director for Multilateral Affairs and Co-operation of the Ministry of Foreign Affairs, Secretary of the Committee.

The Committee shall have a balanced composition, with members whose national and international prestige is recognised, and who possess sufficient technical knowledge, free from external influences. In this sense, among the six members, three of them, including the President, with a casting vote in the event of a tie, carry out their professional tasks outside the structure of the Government, and two of them abroad. Moreover, the three members of the Committee who belong to the government structure have the status of civil servants, therefore they enjoy an independence of assessment, and are familiar with the functioning of the Court.

The profile of the members of the Committee guarantees the presence in this Committee of a broad knowledge of human rights, both at national and European level, the constitutional and legal deployment of human rights in Andorra, the case law of the Court and Andorran legislation, as well as the functioning of the selection procedure.

The Committee met on 15 October 2024 to analyse and assess the various applications received and conducted one-hour interviews with the candidates, in particular to verify that the candidates met the required conditions. The Committee assessed the various candidates on the basis of the following criteria, inter alia: curriculum vitae, experience, motivation and languages.

After deliberation, the Selection Committee decided to submit the national list of the three candidates to the Council of Ministers for approval at its meeting on 16 October 2024.

The Council of Ministers approved the proposed national list and the candidates were informed of the outcome.

I would also like to remind you that the Government of Andorra attaches particular importance to the election of a judge of Andorran nationality, since he/she is best placed to hear cases concerning our country, especially when he/she becomes Judge-Rapporteur for Committee, Chamber and Grand Chamber cases. Since the accession of Andorra to the Council of Europe in 1994, all judges in respect of Andorra have been of Andorran nationality. […]

In that regard, I would like to explain the composition of the Andorran judicial system and the nationality of the judges and magistrates who compose it. This brief introduction may help to understand why the Government of Andorra had to publish the decree calling for applications five times (from 13 December 2023 to 12 April 2024 and 25 September 2024) in order to find the 3 suitable candidates:

  • Batllia: court of first instance and preliminary investigation in civil, administrative and criminal jurisdictional areas, with 17 judges (one president and 16 judges), all of Andorran nationality.
  • The Tribunal de Corts: criminal court, with 6 magistrates (one president, Ms Canòlic Mingorance, and 5 magistrates), 4 of whom are Andorran nationals.
  • The Tribunal Superior de Justicia or High Court of Justice: the highest court, with 9 magistrates (one president and 8 magistrates), 3 of whom are Andorran.
  • The Tribunal Constitucional: The Constitutional Court is the supreme interpreter of the Constitution. It currently has 4 members, including one Andorran (Mr Pere Pastor, who until 31 October 2024 was the judge at the European Court of Human Rights in respect of Andorra).

VII. Publications and other works

My publications and research projects span across various branches of public international law, from the study of international tribunals to international human rights law and international economic law. My study of international human rights law has often stemmed from a comparative and systematic perspective. It often led me to examine comparatively several branches of international law, such as international investment law and human rights law, and to scrutinize the reception of international human rights law in national legal systems through a comparative lens.
