2 Information on national selection procedure for the position of a judge of the European Court of Human Rights

In accordance with Article 141a (6) letter f) of the Constitution of the Slovak Republic (hereinafter referred to as “the Constitution”), the competence of the Judicial Council of the Slovak Republic includes submitting proposals of candidates for judges who should serve for the Slovak Republic in international judicial bodies to the Government of the Slovak Republic.

The process of selecting candidates to serve for the Slovak Republic in international judicial bodies (the national selection procedure), including the European Court of Human Rights, is regulated by Section 27g of Act No. 185/2002 Coll. on the Judicial Council of the Slovak Republic and on Amendments and Additions to Certain Acts (hereinafter referred to as “the Judicial Council Act”).

Pursuant to this provision, on 1 July 2024, the President of the Judicial Council of the Slovak Republic announced an election for three candidates for the position of Judge of the European Court of Human Rights for the Slovak Republic and set the date of the election for 18 September 2024. In the announcement, the President of the Judicial Council of the Slovak Republic invited the eligible petitioners pursuant to Section 27g (1) letter a) of the Judicial Council Act to send their proposal of candidates in the election. The declaration also included the requirements for a candidate under section 27g (2) letters a) – e) of the Judicial Council Act.

In addition to the requirements for the candidate under the legal order of the Slovak Republic, the President of the Judicial Council of the Slovak Republic has also stated the necessity to follow the requirements under Article 21 (1) – (4) of the Convention for the Protection of Human Rights and Fundamental Freedoms (hereinafter referred to as “the European Convention”) and Protocol No. 15 to the European Convention that the proposed candidate must meet. In the Announcement of the Election and in accordance with Article 22 of the European Convention, the President of the Judicial Council of the Slovak Republic stated that the Advisory Panel for the Selection of Candidates for Election as Judges of the European Court of Human Rights, established by Resolution CM/Res (2010) 26, decides on the suitability of the candidates put forward by the Government of the High Contracting Party. The Judge of the European Court of Human Rights is subsequently elected by the Parliamentary Assembly of the Council of Europe on the recommendation of the Advisory Panel.

Within the deadline set in the Announcement of the Election, the Judicial Council of the Slovak Republic received three proposals of candidates for judge of the European Court of Human Rights, which fulfilled the requirements prescribed by law. The proposal of the candidate Ms Daniela Ježová was submitted by the President of the Judicial Council of the Slovak Republic. Mr Ondrej Laciak's proposal was submitted by the Slovak Bar Association and the Notary Chamber of the Slovak Republic, professional legal organisations, and the Slovak Judges Association, the largest professional organisation of judges. Mr Radoslav Procházka's proposal was submitted by the Slovak Bar Association and the Slovak Judges' Association.

All three candidates were publicly heard by the Judicial Council during its meeting on 18 September 2024. After the hearings, the Judicial Council proceeded to vote on these candidates and by Resolutions 304/2024, 305/2024 and 306/2024 of 18 September 2024, elected Ms Daniela Ježová, Mr Ondrej Laciak and Mr Radoslav Procházka as candidates for judges of the European Court of Human Rights. In accordance with Article 141a (6) of the Constitution, the elected candidates were submitted to the Government of the Slovak Republic without undue delay.
