2 Information on national selection procedure for the position of a judge of the European Court of Human Rights

By a letter of 1 February 2023, the Secretary General of the Parliamentary Assembly of the Council of Europe requested the Permanent Representative of Latvia to the Council of Europe to submit a list of three candidates for the position of Judge at the European Court of Human Rights (“the Court”) in respect of Latvia. The Latvian authorities were requested to send the list of candidates and their detailed curricula vitae, as well as a description of the procedure according to which the candidates were selected by 11 March 2024.

On 16 June 2023, the Cabinet of Ministers of the Republic of Latvia issued the Order No. 346 “On the Public Selection Procedure for the Post of Judge at the European Court of Human Rights and the Candidates’ Selection Committee”. The composition of the national selection committee (“the Selection Committee”) was proposed by the Ministry of Foreign Affairs and approved by the Cabinet of Ministers with the above-mentioned Order No. 346. The Selection Committee was composed of representatives from the Constitutional Court, the Supreme Court, the Legal Affairs Committee of the Parliament, the Prosecutor General Office, the Ministry of Justice, the Ministry of Foreign Affairs, the Chancery of the President, the Council of Sworn Attorneys, and the Ombudsman’s Office. Given that the members of the Selection Committee came from a variety of backgrounds and were similar in their professional standing, the composition of the Selection Committee was well balanced and, in line with the established practice, included representatives from a variety of institutions, both governmental and independent.

The composition of the Selection Committee was as follows:

  • Mr Aivars Ostapko, Head Prosecutor of the Department for Supervision of Operation and International Cooperation of the Prosecutor General Office;
  • Ms Ineta Piļāne, Deputy Ombudsman, Head of the Civil and Political Rights Division of the Ombudsman’s Office;

As decided by the Cabinet of Ministers on 16 June 2023, a public and open call for the post of Judge at the Court was published in the official publication Latvijas Vēstnesis and widely disseminated through the official websites of the Cabinet of Ministers, the Ministry of Foreign Affairs, the Ministry of Justice, and domestic courts, enclosing the model curriculum vitae as adopted by the Parliamentary Assembly of the Council of Europe with the Resolution 1646 (2009) “Nomination of candidates and election of judges to the European Court of Human Rights” in Latvian, English, and French. The announcement was also published on the website of the weekly journal for law professionals Jurista Vārds, and on social media platforms of the Ministry of Foreign Affairs.

The call for applications stated that the applicants must meet the requirements laid down in Articles 21 and 23 of European Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) and must have a degree of higher education in law, professional experience acquired in a court, a State institution, or another legal profession, knowledge of the Latvian legal system, international law and human rights law, understanding of the Court’s work, ability to express an opinion and to adopt decisions independently, as well as an excellent command of at least one of the two official languages of the Council of Europe, and basic knowledge of the other official language. The call invited the prospective applicants to submit their applications by post or by e-mail until 1 August 2023. Moreover, before the expiry of the deadline for the submission of applications, the Ministry of Foreign Affairs repeatedly posted a call for applications on its social media platforms. Accordingly, the prospective applicants had ample time to submit their applications. In total, nine applications were received within the deadline.

On 24 August 2023, the Selection Committee held its first meeting during which it adopted the Regulations of the Public Selection Procedure for the Post of Judge at the European Court of Human Rights, which established the procedure for the work of the Selection Committee. The Regulations stipulated that the Selection Committee has quorum if at least eight members participate in the meeting and established that decisions of the Selection Committee are adopted by a majority of members casting their vote. During the meeting, the secretariat of the Selection Committee distributed to all members of the Selection Committee the Information document No.SG‑AS(2023)01rev02 on the Procedure for the election of judges to the European Court of Human Rights, as well as the document “A short guide on the Panel’s role and the minimum qualifications required of a candidate” as prepared by the Advisory Panel. The members of the Selection Committee discussed the information provided in these documents and took note of the preconditions for the national selection procedure and the minimum requirements for candidates. The Selection Committee then assessed whether all nine applicants met the eligibility requirements set out in Articles 21 and 23 of the Convention. On the basis of the information provided in the applications (the curricula vitae, motivation letters, and other documents submitted by the applicants), the Selection Committee concluded that two applicants were not proficient in at least one of the official languages of the Council of Europe (English or French) and rejected their applications. It was then decided that the interviews with the seven remaining applicants would be held during the second meeting of the Selection Committee on 30 October 2023, and that the duration of each interview would be approximately 45 minutes. In order to ensure that all applicants would be asked the same questions, the Selection Committee agreed that the questions would relate to the following four general blocks: (1) the impact of the rulings of the Court on the Latvian domestic legal system; (2) the current challenges in the Court’s work and for the Convention system; (3) the relationship and interaction between the Convention system and the European Union and international legal framework; (4) the applicant’s motivation, previous experience, and professional abilities that would be helpful in discharging the duties of a Judge at the Court. The Selection Committee also agreed that to some of the questions the applicants would be asked to provide their answers in English and French.

Following the first meeting of the Selection Committee, the two applicants who did not meet the eligibility requirements were informed of the decision of the Selection Committee not to move forward with the assessment of their applications. The decision of the Committee was communicated to these two applicants by an official letter. The applicants who qualified for the interviews were informed about the date and time of the interview via e-mail. All seven applicants confirmed that they would be able to attend the interview in person at the scheduled time.

On 24 October 2023, the secretariat of the Selection Committee distributed to the members of the Selection Committee a draft list of 23 questions for the interviews. The questions were grouped in blocks as agreed during the first meeting. The secretariat invited members of the Selection Committee to submit further proposals, amendments to the draft questions, and other questions before the Selection Committee’s second meeting. There were no further suggestions by the members of the Selection Committee regarding the questions to be asked to the applicants.

On 30 October 2023, the Selection Committee held its second meeting during which it interviewed all seven applicants. Before the interviews, the Selection Committee agreed on the proposed list of questions and, based on the information provided by the applicants in the documents they submitted to the Selection Committee, decided that the applicants would be asked to answer in English all questions from the third block, and in French – two questions from the fourth block. Therefore, the interviews were based upon a standardised format of questions, and the applicants’ proficiency in the official languages of the Council of Europe was assessed. Additionally, during the interviews, based on the applicant’s replies to the standardised questions, the Selection Committee asked follow-up questions in order for the applicants to elaborate on the answers they had given and to assess whether the particular applicant had in-depth knowledge about the respective topic. To ensure transparency in the decision-making process, at the beginning of each interview, the Selection Committee also asked each of the applicants whether they had any objections to any of the Selection Committee’s members. None of the applicants expressed any objections.

After interviewing all seven applicants, the Selection Committee assessed the applicants by awarding each of them points on the scale from 1 to 10. The final sum of the points for each applicant was divided by the number of members of the Selection Committee who were present during the respective interview. Following the calculation of the results, the Selection Committee determined the top three candidates who had obtained the highest number of points. […]. The described mechanism ensured that the list of three candidates would be based on the objective competencies of the applicants, their previous experience, and replies given during the interviews.

On 27 February 2024, the Cabinet of Ministers issued the Order No. 156 “On the Approval of Candidacies for the Post of Judge at the European Court of Human Rights”, approving the candidacies of Mr A. Kucs, Mr J. Neimanis, and Ms D. Rezevska and ordering the Ministry of Foreign Affairs to submit the list of three candidates to the Parliamentary Assembly.

IV. Activities and experience in the field of human rights

I have been appointed as a judge since the end of 2007. My professional career as a judge commenced at the Supreme Court in the Department of Administrative Cases. The daily work of the administrative judge in the cassation instance was related to the establishment or development of jurisprudence and protection of the rights of private individuals in particularly important cases. The interpretation and application of the provisions of the Constitution, the European Convention for the Protection of Human Rights and Fundamental Freedoms and other international human rights acts was essential here. At the same time, I also performed the duties of a member of the Disciplinary Collegium of Judges, examining cases of violations of the professional activity of judges.

In 2009, I was the initiator of the establishment of the Association of Administrative Judges of Latvia in order to promote professional growth and further education of administrative judges. Before becoming a judge of the Constitutional Court, I headed the board of the Association and organized several exchanges of experience with administrative judges of Estonia, Lithuania, Austria and Germany, represented professional interests of judges in the government and the parliament (Saeima), presenting various proposals for improving the law. Within a course of 10 years I advocated for the abolition of the administrative immunity of judges, which placed judges in a situation inconsistent with the principle of equality. I also advocated for the compliance of the judges' remuneration system with the Constitution, representing and preparing relevant applications in the Constitutional Court.

On 14 November 2016, the Plenum of the Supreme Court selected me as a judge of the Constitutional Court from among all judges of Latvia, and by the decision of the Saeima of 22 December 2016, I was approved as a judge of the Constitutional Court. The task of the Constitutional Court and my role as a judge of this court is to examine cases regarding the compliance of legal norms with the Constitution and other legal norms of higher legal force and, among other things, to prevent infringement of the fundamental rights of private individuals. Working with the ECHR's jurisprudence and fundamental rights dogmatics is also integral in examining applications, making a decision to initiate a case, preparing a case and drafting a court ruling.

Until the commencement of my career as a judge, from 2003 to 2007, I practiced as an attorney at law. As part of my practice, I had several cases related to the protection of fundamental rights of individuals in labour disputes and disputes with state authorities. In 2002, I participated in the implementation of modern administrative process law in Latvia, being in the first training group, which later trained Latvian state administration officials and administrative judges in administrative process law. I continue to work actively as an expert in the implementation of the right to a democratic legal state and the standard of fundamental rights protection in Central Asian countries and Ukraine.

Simultaneously with the work at the Latvian Bar and court, from the completion of general studies in 2000 until 2018, I have continuously participated in the education of law students, organisation of the study process, conducting seminars, study courses on basic issues of law and application of law, as well as conducting study theses (bachelor's, master's and doctoral theses) at the Faculty of Law of the University of Latvia. As part of my study courses and lessons, I have very often used cases for analysis in fundamental rights issues. In parallel to my work as a judge, I am also a lecturer at the Latvian Judges' Training Centre and in the training sessions for judges. I very often address topics related to effective protection of rights in court, protection of fundamental rights, and methodologically correct application of law. I have participated in the work of the expert group on the training of judges in Europe, organised by the European Commission, in matters of improving the training of judges, including European Union law (including fundamental rights).

In addition to my work as a judge, I devote time to scientific work and research. I have authored several books, countless articles and participated in conferences and a number of projects related to law enforcement. I have often critically analysed the rulings of administrative authorities and courts, which are insufficient, formal or inconsistent with the standards of protection of fundamental rights. The most recent of the books is dedicated to the legal proceedings in the Constitutional Court (including the protection of fundamental rights), while the international scientific project is devoted to the content of the principle of good governance in the member States of the Council of Europe. At present there are several chapters in preparation in my authorship of a book dedicated to public law – on administrative law, on administrative process law, municipal law, administrative offences law and constitutional court procedure law.

I regularly continue my further professional education in European Union law and fundamental rights issues.

Analysis of the argumentation of judgments and concretisation of human rights as general principles of law by the Constitutional Courts, European Court of Justice, European Court of Human Rights.

Introducing of the general principles of law: human rights, legal methods and system principles in the courts and administrative practice; the meaning of legal norm which includes human rights as unwritten legal norms in the contemporary legal theory.
