PACE urges reforms to safeguard democratic institutions in Bosnia and Herzegovina

The Parliamentary Assembly today said it remained concerned about “recent developments in Bosnia and Herzegovina, marked by attacks against the State, the rule of law and the institutions established following the General Framework Agreement for Peace”, while also emphasizing “cause for hope” following decisions that have reversed some of these trends.

Adopting the resolution based on the report by Zsolt Németh (Hungary, ECPA) and Pablo Hispán (Spain, EPP/CD), the Assembly welcomed the annulment by the authorities of Republika Srpska of a series of entity-level laws that had been declared unconstitutional, and called for the prompt appointment of the remaining judges to the Constitutional Court to ensure its full and effective functioning.

The Assembly exhorted political parties to adopt a package of reforms “to improve the functionality of state institutions”, stressing the need for constitutional and electoral reforms to bring the framework into line with the requirements of the European Convention on Human Rights.

It also urged the Presidency to swiftly complete the selection procedure for a judge to the European Court of Human Rights, and encouraged the authorities to continue close co-operation with the Venice Commission.

The Assembly resolved to continue following developments in Bosnia and Herzegovina under its monitoring procedure.
