1 Introduction

1. The Bureau met on 8 October in Strasbourg, on 11 November in Antalya (Turkey) and on 13 December 2010 in Paris. On 8 October, the Bureau appointed me rapporteur for this report. Meanwhile, the Standing Committee met on 12 November 2010 in Antalya.
2. Keeping in mind that the consideration of these reports holds an important place in the agenda of the part-session, and in line with the progress report presented by my predecessor, Mr David Wilshire, in October 2010, I have chosen to keep to the format he proposed.
3. I would suggest that from now on, the progress report should cover the period outside of Assembly sessions, leaving aside the decisions which have already been ratified by the Assembly. Thus, the first part of this report presents the Bureau’s activities since the part-session of October 2010 and up until the part session of January 2011Note ; the activities of the Standing Committee of 12 November 2010 are presented in the second part of the report; the decisions of the Bureau requiring ratification by the Assembly are presented in the third part of the report and the final part of the report presents the decisions ratified by the Standing Committee. I hope that this will enable Assembly members to keep abreast of our activities outside of sessions and to hold a mini current affairs debate on the first day of each part session.
4. The Bureau will hold its next meetings on Monday 24 January 2011 at 8h00 (Strasbourg), Friday 28 January 2011 at 8h30 (Strasbourg) and on 10 March 2011 at 9.30 (Paris). The next meeting of the Standing Committee will be held in Paris (Assemblée nationale) on 11 March 2011.

2 Activities of the Bureau since the last part-session

2.1 Assembly reform

5. On 8 October, the Bureau approved the composition of a Bureau ad hoc Committee on Assembly reform as it appears in Appendix 1, appointed Mr Mignon as Chairperson and agreed to return to this issue in the course of its January 2011 part-session on the basis of a report from the ad hoc Committee.
6. The ad hoc Committee of the Bureau on Assembly reform, set up in order to consider the proposals of the political groups and to prepare a report on this subject, held its first meeting on 12 November 2010 in Antalya, where it held an exchange of views on the written proposals submitted by the EDG and UEL groups, and the personal written proposals by the Chairperson, as well as the oral proposals presented on behalf of the EPP/CD, SOC and ALDE groups.
7. At its meeting on 14 January 2011, the ad hoc committee of the Bureau approved the preliminary draft report on the reform of the Assembly, for transmission to the Bureau of the Assembly with a schedule for consultations of committees, national delegations and political groups of the Assembly and asked the Bureau to propose to the Assembly that the ad hoc committee of the Bureau become an ad hoc committee of the Assembly. This item will be on the agenda of the Bureau of 28 January 2011.

2.2 The situation of Roma in Europe

8. In the context of the implementation of paragraph 23 in Assembly Resolution 1740 (2010) on “The situation of Roma in Europe and relevant activities of the Council of Europe” on 11 November 2010, the Bureauagreed to proceed to an exchange of letters between the President of the Assembly and the Chairman of the European Roma and Travellers Forum (ERTF) formalising co-operation with the Forum. On 13 December, the Bureau approved a draft letter addressed to the Chairperson of the European Roma and Travellers Forum containing proposals for co-operation with the Forum. These proposals have been accepted by the Chairman of the Forum in his reply of 14 January last.

2.3 Co-operation with the European Parliament

9. Further to the meeting between the Assembly Presidential Committee and the Conference of Presidents of the European Parliament in Brussels, the Bureau held an exchange of views on the possible terms of reference and composition of a joint, informal, Parliamentary Assembly /European Parliament body with a view to coordinating information sharing concerning the European Union accession to the European Convention on Human Rights and to tackle the important questions arising from this.
10. On 8 October, the Bureau decided on the principle of establishing this joint body and agreed on the composition and mandate of the Parliamentary Assembly side, attaching particular importance to the arrangements for the participation of European Parliament representatives in the election of judges to the European Court of Human Rights.
11. The Bureau returned to this subject at its meeting in Antalya on 11 November and invited the President to address a letter to the President of the European Parliament on ways of advancing the work of the informal body, which he did on 16 November 2010. On 13 December 2010, the Bureau took note of information provided by the President of the Assembly. On 13 January 2011, the European Parliament Conference of Presidents agreed on the setting up of the informal body. It will be composed of the Chair or Vice-Chair of the Constitutional Affairs Committee, the Chair or Vice-Chair of the Civil Liberties Committee, the Rapporteur of the “EU accession to the ECHR” report and of one representative each for the seven European Parliament Political Groups.

2.4 Co-operation with the Interparliamentary Assembly of the CIS

12. On 13 December 2010, the Bureau took note of a Secretariat memorandumNote and asked the Secretariat to consider, in conjunction with the Secretariat of the Interparliamentary Assembly of the CIS, modalities for future co-operation between the two institutions.

2.5 Co-operation with the Palestinian National Council 

13. On 13 December 2010, the Bureau took note of a memorandum prepared by the SecretariatNote on the request for Partner for Democracy Status by the Palestinian National Council and decided to refer this request to the Political Affairs Committee for report as well as to the Committee on Legal Affairs and Human Rights and to the Committee on Equal Opportunities for Women and Men for opinion.

2.6 Ad hoc committees of the Bureau for the observation of elections and referenda

14. On 8 October, the Bureau approved the following additions to the Guidelines for the observation of elections by the Parliamentary Assembly:
  • “While rapporteurs for the monitoring of, or post-monitoring dialogue with, a given country should be encouraged to join an ad hoc committee to observe an election in that country, they should not be appointed chairpersons thereof. This is to ensure a distinction between election observation as such and monitoring and post-monitoring dialogue in the context of which the findings of an ad hoc committee are followed up.”;
  • “The Chairmanship of the ad hoc committees shall rotate between political groups to ensure, generally, an overall political balance over a 12-month period”.
15. The Bureau also agreed to draw the attention of election observation ad hoc committees to proposals regarding the participation of people with disabilities in the electoral process presented by the Social, Health and Family Affairs Committee.
16. Finally the Bureau also took note of the difficulties of members of certain delegations to attend election observation missions to which they had been appointed and asked the President to raise the matter with the national parliaments which no longer wish to cover the travel expenses of their members.

2.6.1 Early parliamentary elections in Moldova (28 November 2010)

17. On 8 October, the Bureau approved the composition of the ad hoc committee to observe these elections and appointed Mr Saar (Estonia, SOC) as Chairperson. On 13 December 2010, the Bureau took note of oral accounts and of a press release concerning the election observation mission by the ad hoc committee as the final report had not yet been published.

2.6.2 General elections in Bosnia and Herzegovina (3 October 2010)

18. On 11 November, the Bureau approved the report of the ad hoc committee. 

2.6.3 Parliamentary elections in Azerbaijan (7 November 2010)

19. On 11 November, the Bureau appointed Mr Iwinski (Poland, SOC) to replace Mr Wille (Belgium, ALDE), Chairman of the ad hoc committee which observed the elections, who had since left the Assembly, to present the report to the Assembly.

2.7 Other ad hoc committees of the Bureau

20. On 11 November, the Bureau heard statements on the results of the Forum by Mr Harutyunyan, Chairperson of the Ad hoc Committee on the Forum and General Rapporteur for this year’s Forum, and by Mr Von Sydow, Chairperson of the Political Affairs Committee; and agreed to return to this matter once the Forum’s Draft Conclusions had been finalised as part of a post-Forum consultation process.
21. The Bureau, on 8 October, on the proposal of the Committee on Migration, Refugees and Population, nominated Mr Chope (United Kingdom, EDG) to replace Mr Greenway as member of the ad hoc Committee to participate in the Forum for Democracy to be held in Yerevan, Armenia, from 19 to 21 October 2010.

2.8 Follow-up to texts adopted during the fourth ordinary part session of the Assembly in 2010 (Strasbourg, 4-8 October 2010) and of the Standing Committee (Antalya, 12 November 2010)

22. On 8 October 2010, the Bureau:
  • invited the political groups to promote the setting up of ethics committees with a right to sanction racist, antisemitic, xenophobic or islamophobic behaviour or speech and suggested that the President could address a letter to speakers and propose follow-up to the Assembly’s texts [Resolution 1754 (2010) Fight against extremism: achievements, deficiencies and failures] ;
  • proposed to follow up Recommendation 1934 (2010) Child abuse in institutions: ensure full protection of the victims by playing a leading role through the Social, Health and Family Affairs Committee, in the setting up of a parliamentary dimension to the campaign to promote the ratification of the Lanzarote Convention (Council of Europe Convention on the Protection against Sexual Exploitation and Sexual Abuse (CETS No. 201) ;
  • took note that it would be necessary to amend the Rules of enlarged debate on OECD matters to formally introduce a reference to Chile having 7 seats [Resolution 1758 (2010) The activities of the Organisation for Economic Co-operation and Development (OECD)] ;
  • wished to explore the modalities of co-operation with the Development Bank in the future and felt that a memorandum of understanding could be prepared. [Recommendation 1937 (2010) The strategy, governance and functioning of the Council of Europe Development Bank] ;
  • in order to monitor the situation of Roma in Europe and in the light also of the outcome of the high-level meeting held on this topic in Strasbourg on 20 October 2010, referred the matter to the Committee on Migration, Refugees and Population for report and tothe Political Affairs Committee for opinion [Resolution 1760 (2010) Recent rise in national security discourse in Europe: the case of Roma] ;
  • entrusted the Secretariat to explore modalities of co-operation with the ERTF [Resolution 1740 (2010) The situation of Roma in Europe and relevant activities of the Council of Europe].
23. On 13 December, the Bureau:
  • invited the Political Affairs Committee to take responsibility for implementing paragraph 7 of Resolution 1772 (2010)on"Re-engaging in parliamentary dialogue with the United States", in which the Assembly stated that it was eager to renew efforts to revive, in a pragmatic way, parliamentary dialogue with the United States Congress, to establish an exchange of information and, where possible, working relations with counterparts in Congress. [Resolution 1772 (2010)on"Re-engaging in parliamentary dialogue with the United States"];
  • took note of the letter sent by the Secretary General to the presidents of member states’ parliaments asking them to take account of the following resolution when appointing delegations to the Parliamentary Assembly in the framework of the dialogue with national parliaments on this question and to continue its consideration of measures that could be implemented by national parliaments to increase women's representation in the Assembly [Resolution 1781 (2010) on " A minimum of 30% of representatives of the under-represented sex in Assembly national delegations].

2.9 Issues raised by committees

2.9.1 Committee on Rules of Procedure, Immunities and Institutional Affairs

24. The Bureau took note of an opinion of theCommittee on Rules of Procedure, Immunities and Institutional Affairs, on the right of Assembly members to attend Assembly meetings in a Council of Europe member state, in particular as regards the scope and interpretation of the relevant provisions of the General Agreement on Privileges and Immunities of the Council of Europe and the Protocol thereto; asked the Committee to make proposals for concrete action based on this opinion and agreed to return to this issue at a future meeting in the light of such proposals; and invited the Secretary General of the Assembly to remind delegations hosting Assembly meetings of their obligations under the aforementioned General Agreement and Protocol.
25. The Bureau also agreed, on the basis of a letter from the Committee Chairperson and an accompanying Committee memorandum, not to change the Rules of Procedure as regards the duration of the term of office of the President of the Assembly and Committee Chairpersons.

2.9.2 Committee on Legal Affairs and Human Rights

26. The Bureau approved the following theme suggested by the Committee for the Assembly’s debate at its June 2011 part-session on “State of Human Rights in Europe: National Parliaments – Guarantors of Human Rights in Europe”.

2.9.3 Committee on Migration, Refugees and Population

27. The Bureau authorised Mrs Reps (Estonia, ALDE), Committee rapporteur on “Unaccompanied minors in Europe: issues of arrival, stay and return”, to carry out a fact-finding visit to Morocco for the purposes of her report.
28. The Bureau authorised Mr Bugnon (Switzerland, ALDE) to attend the Global Forum on Migration and Development, to be held from 8 to 11 November in Puerto Vallarta, Mexico, at no cost to the Assembly.

2.9.4 Political Affairs Committee

29. The BureauauthorisedMr Volontè, Committee rapporteur on “Request from the Parliament of Morocco for Partner for Democracy” status within the Parliamentary Assembly”, to conduct a fact-finding visit to Morocco for the purposes of his report.
30. The Bureau was informed by Mr von Sydow, Chairperson of the Political Affairs Committee, of his intention to ask that Committee for authorisation to visit KosovoNote ahead of the general elections to be held there on 12 December 2010.

2.9.5 Committee on Social, Health and Family Affairs

31. The Bureautook note of the initiative of the Committee to establish a network of contact parliamentarians to promote ratification and implementation of the Council of Europe Convention on the Protection of Children against Sexual Exploitation and Violence.

2.9.6 Monitoring Committee

32. The Bureau took note of the agreement on the manner of pursuing its work on the consequences of the war between Georgia and Russia.

3 Activities of the Standing Committee (Antalya, 12 November 2010)

33. The Standing Committee held an exchange of views with Mr Ahmet Davutoğlu, Minister for Foreign Affairs of Turkey, Chairperson of the Committee of Ministers of the Council of Europe.
34. The Standing Committee held a current affairs debate on “Recent violent attacks against Christians and other religious communities in Iraq” introduced by Mr Mignon (France, EPP/CD).
35. Moreover, the Standing Committee ratified the credentials of new members of the Assembly submitted by Belgium, Greece, Iceland, Netherlands, Sweden and the United Kingdom and the changes in the composition of Assembly committees in respect of the delegations of Belgium, Greece, Iceland, Netherlands, Sweden and United Kingdom, and in the composition of the Committee on the Honouring of Obligations and Commitments by Member States of the Council of Europe (Monitoring Committee) with regard to the EPP and EDG political groups, as well as of the Committee on Rules of Procedure, Immunities and Institutional Affairs with regard to the EPP, ALDE and EDG political groups.
36. The Standing Committee adopted, on behalf of the Assembly, the texts listed in Appendix  2.

4 Decisions of the Bureau requiring ratification by the Assembly

4.1 Organisation of debates on the activities of the European Bank for Reconstruction and Development (EBRD)

37. At its meeting on 11 November, the Bureau agreed to consult the Committee on Economic Affairs and Development on the question of whether to recommend to the Assembly to hold a debate on the activities of the European Bank for Reconstruction and Development (EBRD) only every second year.
38. On 13 December, the Bureau took note of a letter from the Chairperson ad interim of the Committee on Economic Affairs and Development, Mr. Ertuğrul Kumcuoğlu, informing it that the committee felt that the debate on the activities of the EBRD could take place only every other year, providing that dialogue with that institution was maintained on issues of common interest and decided that the Assembly would hold the debate on the activities of the EBRD as recommended by the committee, meaning the next one would be held in 2012.
39. The Assembly is invited to take note of this decision modifying the co-operation agreement with the EBRD and to ask the President to send a letter to the President of the EBRD modifying the exchange of letters on which this arrangement is based.
