Compliance with human rights, including the right of assembly, in Ukraine

1. The Committee of Ministers has carefully
considered the Honourable Parliamentarian’s written question.
2. It expects that all member States of the Council of Europe
fully respect the human rights and fundamental freedoms enshrined
in the European Convention on Human Rights, including the right
to freedom of assembly and association as guaranteed by Article
11 of the Convention.
3. The Committee recalls that, in December 2013, it approved
a proposal by the Secretary General to establish an International
Advisory Panel (IAP) responsible for examining whether the investigations
into the violent incidents which have taken place in Ukraine from
30 November onwards, including the tragic event in Odessa on 2 May
2014, meet the requirements of the European Convention on Human
Rights.
4. Sir Nicolas Bratza, former President of the European Court
of Human Rights, was appointed Chairman of the IAP. The other two
members are Mr Butkevych, a former judge of the Court, and Mr Oleg Anpilogov,
a former prosecutor.
5. On 26 November 2014, the Chairman of the IAP presented to
the Committee of Ministers the work of the IAP to date as well as
its future planned activities. This information is available on
the Panel’s website (see:

On this occasion, Sir Nicolas Bratza referred to the good level
of co-operation with the Ukrainian authorities. The Committee of
Ministers invites these authorities to continue to co-operate with
the IAP.
