Explanatory note
The term “warring parties” suggests that armed conflict is on-going, which is not the case everywhere.

In the draft resolution, paragraph 5, first sentence, delete the words "in Spain".
Explanatory note
As stated in the Explanatory Memorandum, paragraph 6, the Report focusses on the situation in Cyprus, the Balkans and North and South Caucasus, where people are still missing as a result of conflicts in recent decades. This is not the case in Spain. The reference to this country in the Draft Resolution does not make sense.

In the draft resolution, paragraph 7.1, replace the words "those involved in conflicts" by the following words: "member States and relevant de facto authorities".
Explanatory note
It is a clarification amendment. I suggest addressing our recommendations to the “member States and relevant de facto authorities”, rather than speaking of those involved in conflict, as many recommendations of this resolution can be implemented only by authorities, whether or not there is an on-going conflict.

Explanatory note
Concerning the right to an effective investigation and to know the truth, the United Nations Human Rights Commission stated that the international community should "endeavour to recognise the right of victims of gross violations of human rights, and their families, and society as a whole to know the truth to the fullest extent practicable".

In the draft resolution, replace paragraph 10 with the following paragraph:
"The Assembly recognises the important role played by the ICRC and other organisations such as the ICMP, in resolving cases of disappearance during and after armed conflicts and on raising awareness of the problem of missing persons in Europe. It encourages the ICRC and other organisations to continue their valuable assistance to the countries and regions concerned in solving the issue of missing persons."
Explanatory note
This is to clarify that other international organisations are also involved in this issues, in particular the ICMP, which is a specialised international organisation addressing the issue of missing persons in all of its facets.
