ADraft Resolution

1The Parliamentary Assembly refers to its Resolution 2287 (2019) on strengthening the decision-making process of the Parliamentary Assembly concerning credentials and voting, which, following a period of non-co-operation at the parliamentary level, led to the Russian delegation`s return to the Assembly and confirmed the Assembly`s commitment to dialogue as a means of finding lasting solutions for outstanding issues.
2Furthermore, the Assembly refers to its Resolution 2292 (2019) on the Challenge, on substantive grounds, of the still unratified credentials of the parliamentary delegation of the Russian Federation, in which it resolved to ratify the credentials and called on the Russian delegation to co-operate with the Monitoring Committee and engage in a meaningful dialogue on the fulfilment of its commitments and obligations. It invited the Monitoring Committee to present a report on the honouring of the obligations and commitments by the Russian Federation at its earliest convenience, but no later than in April 2020.

In the draft resolution, paragraph 2, after the words: "called on the Russian delegation to" insert the following words: "fulfil all recommendations included in Resolutions 1990 (2014), 2034 (2015) and 2063 (2015) and".

3The Monitoring Committee has resumed its work with regard to the Russian Federation and organised a number of hearings, which will be taken into account by the co-rapporteurs in their ongoing preparation of the report. The Russian delegation has co-operated fully with the Monitoring Committee.

In the draft resolution, paragraph 3, replace the words: "which will be taken into account by the co-rapporteurs in their ongoing preparation of the report" with the following words: "but has yet to appoint new Rapporteurs and arrange visits to the territory of the Russian Federation, including the occupied territory of Crimea. It is therefore not yet clear what access will be granted to the Rapporteurs."

In the draft resolution, paragraph 3, replace the words: "The Russian delegation has co-operated fully with the Monitoring Committee" with the following words: "The Assembly reserves the right to re-evaluate the Russian credentials during the April Part Session in the light of cooperation or otherwise with the newly appointed Rapporteurs".

4The Assembly notes that, in the past six months since the Russian Federation’s return to the Assembly, some other recommendations included in Resolution 2292 (2019) have also been addressed by the Russian Federation. In particular, all 24 illegally detained Ukrainian sailors captured in the Kerch Strait were returned to Ukraine as part of a hostage exchange. This included one person wanted for questioning in connection with the shooting down of airplane MH17. Some progress has been made with regard to the implementation of the Minsk Agreements. The Russian Federation has participated in so-called “prisoners swaps” and, alongside Ukraine, is preparing other exchanges.

In the draft resolution, paragraph 4, delete the words: ", in the past six months since the Russian Federation's return to the Assembly, some other recommendations included in Resolution 2292 (2019) have also been addressed by the Russian Federation. In particular,"

In the draft resolution, paragraph 4, after the last sentence, insert the following words: "However, it notes with concern the rising tension taking place in the occupied territories of the Donetsk and Luhansk regions".

5With regard to the financial obligations towards the Council of Europe, the Russian Federation has paid all due contributions to the ordinary budget and partial agreements. Unpaid interests are the subject of discussions in the Council of Europe Committee of Ministers.

"The Assembly stands by its Resolution 2028 (2015) on "The humanitarian situation of Ukrainian refugees and displaced persons", calling for the security and respect for human rights of all those who live under the occupation of the Russian Federation in Crimea, for full respect of all the obligations of the occupying State in accordance with international humanitarian law and provide immediate and for unimpeded access for international human rights monitoring missions to the Crimean peninsula."

"The Assembly stands by its Resolution 2259 (2019) "The escalation of tensions around the Sea of Azov and the Kerch Strait and threats to European security" reiterating its commitment to the sovereignty and territorial integrity of Ukraine within its internationally recognised borders and recalls in this respect Resolutions 1990 (2014), 2034 (2015), 2063 (2015) and Resolution 2132 (2016)."

"The Assembly also notes that compliance with Resolution 2132 (2016) on "Political consequences of the Russian aggression in Ukraine", Resolution 2198 (2018) on "Humanitarian consequences of war in Ukraine", Resolution 2231 (2018) on "Ukrainian citizens detained as political prisoners by the Russian Federation" and Resolution 2259 (2019) on "The escalation of tensions around the Sea of Azov and the Kerch Strait and threats to European security", in which it resolutely condemned the grave violations of international law committed by the Russian Federation with regard to the military aggression in eastern Ukraine and the illegal annexation of Crimea, remains to be addressed."

In the draft resolution, after paragraph 6, insert the following paragraph:

"The Assembly also notes that compliance with Resolution 2132 (2016) on "Political consequences of the Russian aggression in Ukraine", Resolution 2198 (2018) on "Humanitarian consequences of the war in Ukraine" and Resolution 2231 (2018) on "Ukrainian citizens detained as political prisoners by the Russian Federation", in which it resolutely condemned the grave violations of international law committed by the Russian Federation with regard to the military aggression in eastern Ukraine, remains to be addressed".

7Furthermore, the Assembly invites the Monitoring Committee to follow closely the ongoing legislative process with regard to the constitutional amendments currently underway in the Russian Federation and explicitly underlines each member State’s obligation to abide by the judgments of the European Court of Human Rights.
8The Assembly resolves to assess the progress made in this respect in the course of 2020 and invites the Monitoring Committee to present the full monitoring report as soon as possible.

In the draft resolution, paragraph 8, replace the words: "as soon as possible" with the following words: "as soon as access to all the necessary territories has been permitted".

9The Assembly emphasises that it constitutes the most important pan-European parliamentary platform where political dialogue on the Russian Federation’s obligations under the Statute of the Council of Europe can take place with the participation of all those concerned, and where the Russian Federation can be held accountable on the basis of Council of Europe’s values and principles

In the draft resolution, at the beginning of paragraph 9, insert the word "While".

In the draft resolution, paragraph 9, after the word: "principles", insert the following words: ". A prerequisite for the participation of the Russian Federation remains compliance with the Resolutions of the Parliamentary Assembly.".

10Therefore, the Assembly does not consider Rule 8.2.a. or 8.2.b. applicable and resolves to ratify the credentials of the Russian Federation.
