Explanatory note
The provisions of the Rule 6 and in particular rules 6.1 (last sentence) and 6.3 of the Rules of Procedure are clearly based on the Article 25 (b) of the Statute of the Council of Europe which prescribes that “the term of office of representatives thus appointed will date from the opening of the ordinary session following their appointment.” The proposed in the draft resolution derogation from Rules 6.1 (last sentence) and 6.3 of its Rules of Procedure will mean a derogation from the Statute of the Council of Europe, which is ratified by all member States and does not provide for mechanisms for such a derogation apart from making amendments. Thereby, the paragraph 7 of the draft resolution exceeds of the powers of the Assembly and contradicts the Statute. This paragraph should be deleted.

Explanatory note
The paragraph 10 of the draft resolution stresses that the Assembly’s Rules of Procedure does not list the members’ rights of participation or representation in the activities of the Assembly and its bodies that may be deprived or suspended by the Assembly. Nonetheless, the proposed clarification of the Rule 10 of Rules of Procedure leaves room for different interpretations of introduced exceptions that leads to legal uncertainty. The best way to clarify the Rule 10 is to setup the exhaustive list of members’ rights with references to relevant articles of the Rules of Procedure that cannot be the subject of a challenge.

Therefore, in order to clarify the scope of rights whose exercise by members of national delegations may be suspended or deprived of within the framework of a challenge or reconsideration of credentials, the Assembly decides to supplement Rule 10 of its Rules of Procedure, adding after Rule 10.1.c the following clarification: “The deprivation or suspension of certain rights of participation or representation in the activities of the Assembly does not affect the rights of Assembly members to take part in the election of judges to the European Court of Human Rights, the Commissioner for Human Rights, the Secretary General and Deputy Secretary General of the Council of Europe and the Secretary General of the Parliamentary Assembly.” as well as the following footnote: “Only members of the Assembly, belonging to delegations whose credentials have been duly ratified by the Assembly, may take part in the election of the highest officials of the Council of Europe: the delegation members who were deprived of some of their rights of participation and representation as a result of a formal decision of the Assembly, including their voting rights, can participate in the election of the aforementioned figures; any parliament not having had its credentials ratified by the Assembly or, by its own choice, not represented in the Assembly by a delegation, has no claim to participation in these elections. When the Assembly is called upon to decide on a challenge to or reconsideration of credentials, it shall refer to the 2014 opinion of the Committee on Rules of Procedure, Immunities and Institutional Affairs and will not introduce any additional sanctions to those set out in that opinion.”

In the draft resolution, after paragraph 12, insert a new paragraph: "During the last 70 years the Assembly has been extremely cautious when considering the non-ratification of credentials, and it has been extremely reluctant to turn down credentials. This has happened only twice - in respect of the delegations of Greece in 1969 and Turkey in 1981 - even if credentials of several delegations were challenged several times during this period. Deprivation of some of the rights of national delegations has happened only three times in the history of the Assembly - each time with respect to the delegation of the Russian Federation (2000, 2014 and 2015). As the existing sanction system has been exercised with the utmost care and consideration for the past 70 years, the Assembly preserves itself the right to continue exercising sanctions in the same way as it has done so far until a new and better joint sanction system with the Committee of Ministers is in place."

In the draft resolution, after paragraph 12, insert a new paragraph: "With this Resolution, the Assembly reaches out its hand to the Russian Federation to find a positive way out of the current crisis. We invite the Russian Federation to accept this friendly gesture by showing its renewed commitment to the Rule of Law. The suspects of the murder of Alexander Litvinenko, the murder attempt of Sergei and Yulia Skripal and the indicted Russian Officers allegedly related to the downing of Malaysian Airways MH17 are still at large on the territory of the Russian Federation. The Assembly calls upon the Russian authorities to spare no effort to honour the extraditing requests by various member States. In the absence of an extradition and/or unsatisfactory progress made by the Russian Federation, the Assembly can then revisit the decisions taken in the report "Strengthening the decision-making process of the Parliamentary Assembly concerning credentials and voting" and to reinstate the old sanction mechanism in the same way as it has been cautiously applied in the past.
