Explanatory note

No guarantees have been given by the Committee of Ministers that the joint procedure will actually be developed. No steps have been taken by the Committee of Ministers to even start such a procedure. Therefore it is wise to first negotiate a new procedure before deleting the existing one.

9However, the Assembly recalls that it may decide, pursuant to Rule 10.1.c of its Rules of Procedure, to take collective measures against its members by depriving or suspending the exercise of a number of participation and/or representation rights in the activities of the Assembly and its bodies, based on a breach or a violation of the provisions of its Rules of Procedure or the Statute of the Council of Europe, in the context of the procedure for challenging or reconsidering national delegations’ credentials on procedural or substantive grounds.

In the draft resolution, replace paragraph 9 with the following paragraph:

In the draft resolution, replace paragraph 9 with the following paragraph: “However, the Assembly recalls that it may decide, pursuant to Rule 10.1.c of its Rules of Procedure, to take collective measures against its members by depriving or suspending the exercise of a number of participation and/or representation rights in the activities of the Assembly and its bodies, based on a breach or a violation of the provisions of its Rules of Procedure, the Statute of the Council of Europe or persistent failure by member State to honour its obligations and commitments and lack of its co-operation in the Assembly’s monitoring procedure, in the context of the procedure for challenging or reconsidering national delegations’ credentials on procedural or substantive grounds.”

Explanatory note

The aim of this amendment is to highlight the substantive grounds on which credentials may be challenged according to the rule 8.2 and to reconfirm the exceptional importance of the Assembly’s monitoring procedure, as a control mechanism of compliance by member States with their obligations and commitments.

In the draft resolution, paragraph 9, first sentence, replace the word “However” with the word “Therefore”.

In the draft resolution, paragraph 9, first sentence, replace the word “decide” by the word “conclude”.

In the draft resolution, paragraph 9, delete the words “on procedural or substantive grounds”.

In the draft resolution, after paragraph 9, insert the following sentence: "The Assembly highlights that the restrictions imposed on the member State are designated to secure other members of the Council of Europe from any undemocratic influence."

10The Assembly recalls that the members’ rights of participation or representation in the activities of the Assembly and its bodies that may be withdrawn or suspended by the Assembly are not listed in the Assembly’s Rules of Procedure. It is up to the Assembly, when deciding, by resolution, on a challenge to or reconsideration of credentials to determine the rights that may be affected. However, in order to ensure the coherence of the Organisation’s internal legal framework, the Assembly, in its decisions, should continue to comply with the Statute of the Council of Europe and to take into due consideration relevant decisions taken by the Committee of Ministers. Therefore, to ensure that the member States’ right and obligation to be represented and to participate in both statutory bodies of the Council of Europe is respected, the Assembly decides to supplement Rule 10 of its Rules of Procedure, adding after Rule 10.1.c the following clarification:

In the draft resolution, paragraph 10, third sentence, delete the following words: “(…) and to take into due consideration relevant decisions taken by the Committee of Ministers.”

Explanatory note

The Council of Europe consists of two organs, the Committee of Ministers and the Parliamentary Assembly (article 10 of the Statute). Both organs should be independent of each other.

In the draft resolution, paragraph 10, replace the last sentence with the following sentence: “The members’ rights according to the Rule 35, Rule 39, Rule 43 and Rule 44 shall not be suspended or withdrawn in the context of a challenge to or reconsideration of credentials”.

Explanatory note

The paragraph 10 of the draft resolution stresses that the Assembly’s Rules of Procedure does not list the members’ rights of participation or representation in the activities of the Assembly and its bodies that may be deprived or suspended by the Assembly. Nonetheless, the proposed clarification of the Rule 10 of Rules of Procedure leaves room for different interpretations of introduced exceptions that leads to legal uncertainty. The best way to clarify the Rule 10 is to setup the exhaustive list of members’ rights with references to relevant articles of the Rules of Procedure that cannot be the subject of a challenge.

The Assembly expresses the hope that the Committee of Ministers and the newly elected Secretary General can come up with a new joint sanction procedure by January 1st 2020. In the absence of a new joint sanction procedure and/or unsatisfactory progress, the Assembly can then revisit the decisions taken in the report “Strengthening the decision-making process of the Parliamentary Assembly concerning credentials and voting” and to reinstate the old sanction mechanism in the same way as it has been cautiously applied in the past. The Assembly also calls upon all 47 member States and the Russian Federation in particular to constructively engage in this process and to abide by the Statute.
