In the draft resolution, replace paragraph 2 with the following paragraph:
"While the right to freedom of expression is not absolute, any limitation thereof must only take place as a last resort, has to be proportional and carried out with utmost caution, with legal guarantees of swift and effective judicial oversight, in order to avoid censorship, State-imposed or otherwise. The legal obligation of social media to remove harmful content that is lawfully declared illegal in an appropriate national procedure should not be abused, as it could effectively lead to imposing such censorship."
Explanatory note
The amendment underlines that limitations of freedom of expression may only be imposed as a last resort and that efective legal measures for the parties concerned should always be provided.

", as well as of the language and the context of the country from which the content originates. However, in the event of a military conflict between two countries, moderators from one country party to the conflict should not moderate content originating from the other"

In the draft resolution, after paragraph 14, insert the following paragraph:
"As a general rule, permanent removal should only affect content that is lawfully deemed illegal in the framework of an appropriate national procedure, with judicial oversight available for all parties concerned, prior to any removal. Deviations from this principle should only be exceptional, in especially grave matters related to national security. Nonetheless, it is always essential to avoid creating procedures that allow for judicial control that is delayed or postponed, effectively denying justice."
Explanatory note
The amendment underlines that removal should always be exceptional and subject to prior judicial control (with exceptions in matters related to national security), in order to avoid vague guarantees of justice that is overly delayed and thus effecitvely denied.

In the draft resolution, after paragraph 17, insert the following paragraph:
"refrain from adopting regulations or undertaking measures that would allow or oblige social media platforms or other internet service providers to remove online content solely by virtue of an administrative decision, without effective judicial oversight, available for all parties concerned prior to such removal; any deviations from this principle may only be justified by national security and should always be exceptional;"
Explanatory note
The amendment aims to establish a principle that any removal of online content should - as a general rule, save for gravest matters of national security - always be subject to judicial control prior to such removal, in order to limit potential abuse of power by govt. controlled administrative bodies

"in co-operation with the press or media organisations, implement a system of verification of media and journalist accounts, together with robust mechanisms to protect them from online harassment, hacks and fraud, and develop social media guidelines for press or media organisations on the publication of information on sensitive issues, with a view to avoiding unnecessary moderation restrictions on this type of content;"
